On November 15, 2024, the Minister of Transport of Vietnam issued Circular 43/2024/TT-BGTVT guiding Decree 57/2024/ND-CP on the management of dredging activities within sea port waters and inland water regions.

According to Article 14 of Circular 43/2024/TT-BGTVT, the content of inspection and supervision work for dredging maintenance projects on public maritime channels and inland waterways is implemented according to the provisions of Article 5 of Decree 57/2024/ND-CP, relevant legal regulations, and the following details:

(1) Construction supervision is carried out according to construction law and ensures the following requirements:

- Supervision of construction is implemented throughout the entire construction process from commencement, during execution, to completion and acceptance of the work;

- Supervision of dredging construction equipment, transporting, dumping dredged materials at the dredging site, the route to dump the dredged materials, and at the dumping site. Collect and compile field information and data from dredging monitoring equipment installed on dredging and transportation vehicles.

Take photos of the storage hold of the dredging transport equipment at the following times: beginning of receiving dredged materials at the construction area; end of receiving dredged materials to move to dumping site; end of travel to the dumping site and end of dumping to return to the construction area.

(2) The project management unit is responsible for inspecting, urging the supervisory consultancy, construction contractor to record a dredging construction log according to the form specified in Appendix I attached to Circular 43/2024/TT-BGTVT.

(3) During the construction period, the project management unit urges the supervisory consultancy to prepare a weekly report and send it via post or directly to the investor and project management unit according to the form specified in Appendix II attached to Circular 43/2024/TT-BGTVT. The weekly report must be prepared and sent no later than the third day of the following week of the reporting week.

(4) Inspection and data storage work from dredging monitoring equipment installed on dredging construction, transport, and dumping equipment is regulated as follows:

- Prior to the construction project implementation, the investor directs the project management unit to cooperate with supervisory consultancy units, AIS information management and exploitation service providers, and construction contractors to inspect the operation of dredging monitoring equipment installed on construction, transport, and dumping equipment. The inspection result is recorded in minutes according to the form in Appendix III attached to Circular 43/2024/TT-BGTVT;

- Construction contractors are responsible for providing complete data obtained from the recording equipment installed on dredging transport and dumping vehicles to the investor and project management unit;

- Supervisory consultancy is responsible for arranging sufficient personnel on the construction site throughout the work to execute and compile complete photos on the transport and dumping vehicles (the dredging storage hold) in compliance with regulations and provide them alongside the weekly supervisory consultancy report specified in Appendix II attached to Circular 43/2024/TT-BGTVT for the investor and project management unit;

- AIS information management and exploitation service providers supporting dredging equipment management are responsible for storing field data on the number of vehicles, location, travel speed, and stopping time from the AIS devices installed on participating construction, transport, and dumping vehicles;

- The project management unit is responsible for storing data from recording devices installed on construction equipment provided by construction contractors and photos on the dredging transport and dumping vehicles (the dredging storage hold) at times provided by supervisory consultancy;

- Data obtained from dredging monitoring equipment installed on construction, transport, and dumping vehicles must be stored for a period of 3 years.
