On June 29, 2024, the National Assembly passed the Law on management and use of weapons, explosives and combat gears 2024.

Conditions for and responsibilities of people assigned to use weapons, explosives and combat gears in Vietnam from January 1, 2025

According to Article 6 of the Law on management and use of weapons, explosives and combat gears 2024, conditions and responsibilities for individuals assigned to use weapons, explosives, and supporting tools are as follows:

- The assigned individual must meet the following conditions:

+ Full civil act capacity;

+ Good moral character, adequate health suitable for the assigned tasks;

+ Trained and certified in the use of weapons, explosives, and supporting tools, except for those in the People's Army, Coast Guard, or Public Security who have been trained and authorized to use these tools;

+ Not under administrative penalty, criminal prosecution; if convicted by court judgment, the record must be expunged.

- The assigned individual has the following responsibilities:

+ Use weapons, explosives, and supporting tools properly;

+ Carry the certification and permit, except for those in the People's Army, Coast Guard, or Public Security;

+ Properly store these tools according to policies and procedures to ensure safety and avoid loss or damage;

+ Hand over the tools and permits to the responsible manager after completing the task or the end of the assigned period.

Conditions for and responsibilities of people assigned to manage warehouses and places for keeping weapons, explosives, explosives precursors and combat gears in Vietnam

Article 7 of the Law on management and use of weapons, explosives and combat gears 2024 stipulates the conditions for and responsibilities of people assigned to manage warehouses and places for keeping weapons, explosives, explosives precursors and combat gears in Vietnam as follows:

- Individuals assigned to manage warehouses of military weapons, explosives, and supporting tools must meet the following conditions:

+ Full civil act capacity;

+ Good moral character, adequate health suitable for the assigned tasks;

+ Not under administrative penalty, criminal prosecution; if convicted by court judgment, the record must be expunged;

+ Trained and certified in warehouse management, storage of military weapons, explosives, and supporting tools, and trained in fire prevention and fighting; appointed by competent authorities;

+ Well-versed in regulations and policies on managing and storing weapons, explosives, and supporting tools.

- Individuals assigned to manage warehousing of industrial explosives and precursors must meet the following conditions:

+ Meet the conditions in points a, b, and c of clause 1, Article 7 of the Law on management and use of weapons, explosives and combat gears 2024;

+ Trained and certified in safety techniques for industrial explosives and precursors, and trained in fire prevention and fighting;

+ Well-versed in regulations and policies on managing and storing industrial explosives and precursors.

- Individuals assigned to manage warehouses of weapons, explosives, and precursors and supporting tools must strictly follow policies and procedures to ensure safety and avoid loss or damage.

The Law on management and use of weapons, explosives and combat gears 2017 has been amended and supplemented under the Law on Amendments and Supplements to Some Articles of the Law on management and use of weapons, explosives and combat gears 2019 and the Enterprise Law 2020 which will be invalid from the effective date of the Law on management and use of weapons, explosives and combat gears 2024, except for the following:

- Provisions in Article 17, Article 35, and clause 1, Article 52 of the Law on management and use of weapons, explosives and combat gears 2017 as amended under the Law on Amendments and Supplements to Some Articles of the Law on management and use of weapons, explosives and combat gears 2019 and the Enterprise Law 2020 will remain effective until June 30, 2025;

- Provisions in Article 75 of the Law on management and use of weapons, explosives and combat gears 2024.
