Annulment of Circular 101/2007/TT-BTC on the use of the Fund for supporting people living with HIV/AIDS in Vietnam

On August 23, 2024, the Minister of Finance issued Circular 63/2024/TT-BTC abolishing Circular 101/2007/TT-BTC providing guidelines on the management and use of the Fund to Support HIV/AIDS Infected Persons.

From October 15, 2024, the regulations on the management and use of the Fund to Support HIV/AIDS Infected Persons in Circular 101/2007/TT-BTC will cease to be effective.

As known, according to Circular 101/2007/TT-BTC, the Fund to Support HIV/AIDS Infected Persons was established with the aim of mobilizing contributions and sponsorships from domestic and foreign agencies, organizations, and individuals to support HIV/AIDS infected persons in medical examination and treatment.

The Central Fund to Support HIV/AIDS Infected Persons is established, managed, and operated by a decision of the Minister of Health; the Local Fund to Support HIV/AIDS Infected Persons is established by the decision of the Chairman of the People's Committee of provinces and centrally-run cities (hereinafter referred to as the provincial People's Committee) and assigned to the Department of Health for management and operation.

The Fund to Support HIV/AIDS Infected Persons has its own legal personality; it has its own seal; it is allowed to open accounts in banks to receive contributions and sponsorships from domestic and foreign organizations and individuals and to open accounts at the State Treasury to receive financial support from the state budget and support from HIV/AIDS prevention projects under the national target program on the prevention of some social, dangerous epidemic diseases and HIV/AIDS. At the end of the financial year, any remaining balance of the Fund (if any) shall be carried forward to the following year to continue being used according to regulations.

The Fund must organize and implement accounting and statistical work in accordance with the law on accounting and statistics; it must publicize the situation of mobilizing, managing, and using the Fund as specified in Circular 19/2005/TT-BTC guiding the financial publicity for funds from the state budget and funds from people's contributions.

Among them, the expenditures to support HIV/AIDS infected persons of the Fund to Support HIV/AIDS Infected Persons include:

(1) For the Central Fund:

- Support for HIV/AIDS infected persons in difficult circumstances belonging to poor households (according to the poverty threshold specified in Decision 170/2005/QD-TTg dated July 8, 2005 of the Prime Minister of the Government of Vietnam) when receiving medical examinations and treatments at central-level medical facilities, including:

+ Support for medical examination and treatment costs for HIV/AIDS infected persons not covered by health insurance.

+ Support for meals during the treatment period.

- Support for the Provincial Fund for the Support of HIV/AIDS Infected Persons of provinces, centrally-run cities when necessary.

(2) For the Provincial Fund:

- Support for HIV/AIDS infected individuals with specific addresses authorized by the sponsoring organization or individual.

- Support for HIV/AIDS infected persons in difficult circumstances belonging to poor households when receiving medical examinations and treatments at local medical facilities, including:

+ Support for medical examination and treatment costs for HIV/AIDS infected persons not covered by health insurance.

+ Support for meals during the treatment period.

- Support for spouses or children of HIV/AIDS infected persons in difficult circumstances belonging to poor households, including:

+ Costs for HIV testing for spouses and children of HIV/AIDS infected persons.

+ Costs for counseling, providing guidance materials on care and treatment of HIV/AIDS infected persons at home and in the community.

- Support for antiretroviral drugs for facilities managing, caring for, and treating HIV/AIDS infected persons.

- Support for families adopting and caring for end-stage HIV/AIDS infected persons at home.

The level of support for each subject and the expenditure content specified in this section shall be decided by the Minister of Health (for the Central Fund) and the Chairman of the provincial People's Committee (for the Local Fund) based on the financial capacity of the Fund.
