In April and May, employees are entitled to 3 days off (excluding the adjacent weekend) for major holidays such as Hung Kings Anniversary (1 day) and Victory Day 30/4 and International Labor Day 1/5 (2 days). Therefore, what are salaries and bonuses for employees working these days in Vietnam?

According to current regulations, employees who go to Laos on the occasion of Hung King's death anniversary on March 10, April 30, and May 1 will be paid salaries and bonuses as follows:
(1) Salary
According to the provisions of Clause 1, Article 112 of Vietnam's Labor Code 2019, during these holidays, employees are entitled to rest and receive a full salary. If employees go to work on these days, according to the provisions of Point c, Clause 1, Article 98 of Vietnam's Labor Code 2012 and Article 55 of Decree 145/2020/ND-CP, they will be entitled to at least 300% of their wages, excluding wages for holidays and paid days off for employees receiving daily wages.
If employees work at night, they will be paid at least 30% of the salary calculated according to the salary unit price or the salary determined according to the work of the normal working day.
If employees work overtime at night on these days, aside from the salary as prescribed in Clauses 1 and 2 of Article 98 of the Labor Code 2019, they will also be paid an additional 20% of the salary calculated according to the salary unit price or salary according to the work done during the day.
Thus, if the employee works overtime at night on the holidays of March 10, April 30, and May 1, the total amount of wages received by the employee for this overtime period as prescribed is at least 490% of the salary for that number of hours of the normal working day.
Note:
- Night work hours are calculated from 10 pm to 6 am the next day.
- Employees who work overtime on public holidays and New Year holidays that coincide with weekly rest days shall be paid overtime wages on public holidays and Tet holidays. In the case of working overtime on a compensatory day off when a public holiday or Tet coincides with a weekly rest day, the employee shall be paid for overtime work on the weekly rest day.
(2) Bonus
This amount is not mandatory but depends on the regime and policy of each company for employees, which may or may not be available.
Enterprises and employers will base their decisions on the situation and results of their company's operations on whether to reward or not reward their employees. The level of bonus offered is also completely dependent on the regime of each company.
