To be specific, the Draft has added the act of "imposing fines" as one of the prohibited acts in labor law. From February 1, 2021, businesses are not allowed to impose fines on employees under any circumstances.
The current regulation in the Labor Code 2012 already prohibits employers from imposing fines on employees, but this prohibition only applies in cases of disciplinary action. Specifically, it prohibits employers from imposing fines or wage cuts in place of handling labor discipline.
It can be seen that the Draft continues to inherit the regulations of the Labor Code 2012 but has expanded the scope.
Additionally, alongside the acts prohibited under current regulations, the Draft also adds other prohibited acts in labor law, such as discrimination based on national origin, skin color, social origin, age, marital status, pregnancy, family responsibilities, or due to reasons of establishing, joining, and participating in the activities of trade unions, or employees' organizations within the enterprise.
