Foreign Workers Required to Contribute to Mandatory Social Insurance from January 01, 2018

This is the content mentioned in the Draft Decree guiding the Law on Social Insurance regarding compulsory social insurance for employees who are foreign nationals working in Vietnam.

From January 01, 2018, foreign workers who are citizens working under indefinite-term labor contracts, fixed-term labor contracts, seasonal labor contracts, or a specific job with a term of one month or more with employers in Vietnam are subject to mandatory social insurance if they possess one of the following documents issued by competent authorities of Vietnam:

- Work permit;- Practice certificate;- Practice license.

05 mandatory social insurance benefits for foreign workers

The aforementioned foreign workers are subject to mandatory social insurance benefits as regulated by the Law on Social Insurance, which includes the following policies:

- Sickness;- Maternity;- Accidents at work – occupational diseases;- Retirement;- Death.

Workers receiving retirement pensions or monthly social insurance allowances who no longer reside in Vietnam are entitled to the following social insurance policies:

- A one-time allowance when no longer residing in Vietnam and wishing to receive a one-time allowance.- The one-time allowance level for workers is implemented following the provisions in Clauses 2 and 3 of Article 65 of the Law on Social Insurance.

Social insurance contribution rates and methods of contribution

- For workers: 8% of the monthly salary into the retirement and death funds.- For employers:- 3% into the sickness and maternity fund;- Up to 1% into the occupational accident and disease fund, with the specific rate determined by the Government of Vietnam;- 14% into the retirement and death funds;

Dossiers and procedures for resolving social insurance policies

The draft Decree stipulates the dossiers and procedures for resolving social insurance policies, which include:

- Dossiers and procedures for resolving sickness policies, recuperation allowances after sickness;- Dossiers and procedures for resolving maternity policies, recuperation allowances after maternity;- Dossiers and procedures for resolving occupational accident and disease insurance policies, recuperation allowances after occupational accidents and diseases;- Dossiers and procedures for resolving retirement pensions;- Dossiers and procedures for resolving one-time social insurance;- Dossiers and procedures for resolving death policies;- Dossiers and procedures for resolving social insurance policies for those receiving retirement pensions or monthly social insurance allowances who no longer reside in Vietnam.
