55 occupations in the aviation sector eligible for early retirement as of 01/03/2021 in Vietnam

Recently, the Ministry of Labor, War Invalids and Social Affairs issued Circular 11/2020/TT-BLDTBXH on the list of arduous, hazardous and dangerous occupations and works, and extremely arduous, hazardous and dangerous occupations and works. The Circular promulgates 55 occupations and works in the aviation field that are eligible for early retirement in Vietnam.

According to the regulations stated in Point b of Clause 1 of Article 54, and Point c of Clause 1 of Article 55 of the Law on Social Insurance 2014, as amended by Article 219 of the Labor Code 2019, employees who have participated in social insurance for a minimum of 20 years are eligible for early retirement if they fall into one of the following cases:

  • Case of no work capacity reduction: Employees who are at least 55 years and 3 months old for males and at least 50 years and 4 months old for females (after 2021, increasing by 3 months annually for males and 4 months annually for females) doing laborious, toxic and dangerous occupations or highly laborious, toxic and dangerous occupations listed by the Ministry of Labor - Invalids and Social Affairs for a minimum of 15 years.
  • Case of work capacity reduction: Employees doing highly laborious, toxic and dangerous occupations listed by the Ministry of Labor - Invalids and Social Affairs for 15 years or more and have a work capacity reduction of 61% or more.

The Ministry of Labor—Invalids and Social Affairs has recently issued a list of laborious, toxic and dangerous occupations or highly laborious, toxic and dangerous occupations under Circular 11/2020/TT-BLDTBXH, including 1838 occupations in various fields such as pharmaceuticals, mechanical engineering, metallurgy, chemicals, transportation, electricity, textiles, aviation, etc. Particularly in the aviation sector, Circular 11/2020/TT-BLDTBXH has issued a list of 55 laborious, toxic and dangerous occupations or highly laborious, toxic and dangerous occupations.
