To avoid being fined, car drivers should not drive continuously for more than 4 hours

These regulations are stipulated in the Road Traffic Law 2008 enacted by the National Assembly on November 13, 2008, and effective from July 1, 2009.

To be specific, according to Article 65 of this Law: "The working hours of a car driver must not exceed 10 hours per day and the driver must not drive continuously for more than 4 hours."

This regulation aims to control the working hours of car drivers, especially long-distance bus drivers, tour bus operators, freight transporters, etc., thereby minimizing unfortunate traffic accidents that may occur if they overwork, regardless of their health condition, affecting passengers and other road users.

At Point d, Clause 6, Article 23 of Decree 100/2019/ND-CP, it stipulates a fine ranging from VND 3,000,000 to VND 5,000,000 for drivers who operate their vehicles beyond the stipulated time specified in Clause 1, Article 65 of the Road Traffic Law. In addition to the monetary fine, they may also be subject to a driving license suspension of 01 month to 03 months.

Inheriting this regulation from the 2008 Road Traffic Law, the Draft Revised Road Traffic Law currently under consultation, once again emphasizes that car drivers must not drive their vehicles for more than 10 hours within 24 hours and must not drive continuously for more than 4 hours. Specifically, Clause 7, Article 10 of the Draft clearly states:

Article 10. General Rules

...

7. The driver must ensure their physical and mental health. The driving time of a car driver must not exceed 10 hours within 24 hours and must not drive continuously for more than 4 hours.

...

Furthermore, this Draft also outlines many notable new regulations, such as:

- Provision for issuing A0 driving licenses for drivers of motorbikes (including electric motorbikes) with an engine displacement under 50 cm3 or an electric motor power not exceeding 04 kW (According to the 2008 Road Traffic Law, operators of motorbikes under 50 cm3 do not require a driving license).

- Article 13 of the Draft stipulates that a green light signals permission to go, except when the intended direction is congested.

- Clause 3, Article 27 of the Draft stipulates: "Throughout the day, motorbikes, electric bicycles, and electric motorbikes must have their identifying lights on as per the manufacturer's design, or at least have one front low beam light and one rear red light on when participating in traffic."
