On December 30, 2019, the Government of Vietnam promulgated Decree 100/2019/ND-CP on administrative penalties in the field of road and railway traffic.

Complete new penalty levels for cars and motorcycles from January 01, 2020
Besides penalizing violations of road traffic rules, Decree 100/2019/ND-CP also stipulates penalties for violations in the use and exploitation within the land allocated for roads.
To be specific, inheriting the previous provisions in Decree 46/2016/ND-CP, Point a, Clause 5, Article 12 of Decree 100/2019/ND-CP prescribes a fine ranging from 2,000,000 VND to 3,000,000 VND for individuals, and from 4,000,000 VND to 6,000,000 VND for organizations committing any of the following violations:
“a) Illegally erecting tents, stalls, entrances, gates, fences of all types, or other constructions within the land allocated for roads.”
Accordingly, under the above regulation, from January 01, 2020, any individual who illegally erects tents, gates, etc., within the land allocated for roads will be fined up to 3,000,000 VND. If the violator is an organization, the fine will be doubled, up to 6,000,000 VND. Particularly, if the illegal erection of tents, stalls, or other temporary constructions takes place within urban areas such as highway tunnels, overpasses, pedestrian tunnels, and underpasses, the fine will range from 4,000,000 VND to 6,000,000 VND for individuals, and from 8,000,000 VND to 12,000,000 VND for organizations.
In addition to fines, individuals and organizations in violation will be required to remedy the consequences by dismantling the illegally constructed buildings (without permits or not in accordance with permits) and restoring the original state altered by the administrative violation.
