On June 19, 2020, the Ministry of Public Security issued Circular 64/2020/TT-BCA stipulating the procedures for investigating and resolving inland waterway traffic accidents by the Traffic Police force in Vietnam.
Within 12 Hours, initial information must be immediately updated into the traffic accident database system in Vietnam (Internet image)
To be specific, in Article 22 of Circular 64/2020/TT-BCA, it is stipulated that Traffic Police must record all traffic accidents occurring on the assigned patrol and control areas into the Traffic Accident Monitoring Book and update traffic accident information into the Traffic Accident Database System in Vietnam as follows:
- Within 12 hours, initial information about the traffic accident must be updated into the Traffic Accident Database System, including: time and place of the traffic accident; number of deaths, missing persons; number of injured persons;
- During the investigation, verification, and resolution of the traffic accident, Traffic Police officers shall continue to correct and update additional information about the vehicles involved in the traffic accident, such as: registration number, vehicle type, license plate, payload; vehicle owner, year of birth, address, phone number (if any); direction of motion before the accident, technical safety conditions, damage, vehicle status; information about the crew, vehicle operator, and victim: full name, date of birth, gender, nationality, occupation, address, competency certificate number, expiry date, competency certification class, injury status, use of alcohol, beer, narcotics, and other strong stimulants prohibited by law; other information related to the traffic accident;
- For district-level police agencies that have not yet implemented the Traffic Accident Database System, they must send complete traffic accident information in writing to the Provincial Traffic Police Department for updating into the Traffic Accident Database System. The Provincial Traffic Police Department is responsible for urging district-level police to provide complete traffic accident information for entry into the Traffic Accident Database System.
- Once all the information on the traffic accident is entered, the Traffic Police officer sends a completion approval request. The leadership of the agency/unit reviews and verifies the updated information to approve the completion of the traffic accident file in the Traffic Accident Database System or does not approve, requiring the officer/soldier to correct the information to match the file/documents collected during the investigation and resolution of the traffic accident.
- For traffic accidents occurring on routes or areas assigned to Traffic Police agencies/units for patrol and control, but investigated and resolved by the Investigative Police Agency, the responsible Traffic Police agency/unit must closely coordinate with the Investigative Police Agency from the crime scene examination to the completion of the investigation, and receive the investigation results and resolution of the traffic accident from the Investigative Police Agency (information about the related vehicles, information about involved crew members: captain, deputy captain, chief engineer, deputy engineer, sailor, mechanic, or inland watercraft operator; victims; witnesses and informants; Decision to prosecute the criminal case, to prosecute the accused, Investigation Conclusion or other related documents for full updating into the Traffic Accident Database System.
- If there are errors in the traffic accident file in the Traffic Accident Database System and it needs to be deleted or unlocked (for approved files), the Traffic Police officer must report to the Leadership of the agency/unit and send a deletion or unlock request to the Traffic Police Department for consideration.
Note: Within 07 days from the date of completion of the investigation and resolution of the traffic accident, the agencies/units must complete the update of all information on the traffic accident into the Traffic Accident Database System.
