Why Did Graceful Vietnamese Entrepreneurs 2016 Violate Regulations?

Recently, the Chief Inspector of the Ministry of Culture, Sports & Tourism stated that the Ho Chi Minh City Department of Culture, Sports' permission to organize the "Duyen dang doanh nhan Viet 2016" contest violated legal regulations.

The case has caused considerable controversy among the contestants and relevant authorities.

Surrounding the issue is the awarding of prizes to 30 out of 50 contestants, one title awarded to many people, and in addition, the contest organizers selling prizes to contestants citing the reason of fundraising for sponsors to create costs and a platform for the contestants. Notably, the Inspectorate of the Ministry of Culture, Sports & Tourism believed that the contest was organized before a license was issued and specifically stated, "NSV Media Joint Stock Company organized the contest several days before being licensed by the competent authority," which violated the regulations on the organization of beauty and modeling contests according to Decree 79/2012/ND-CP of the Government of Vietnam.

According to Decree 79/2012/ND-CP and Decree 15/2016/ND-CP:

- The entity hosting the art performance and fashion show must have a permit for organizing art performances and fashion shows; beauty and modeling contests as per regulations;

- They must notify in writing about the content of the performance program.

Furthermore, Article 14 of Decree 158/2013 stipulates administrative penalties for violations concerning beauty and modeling contests as follows:

  • "1. Fines ranging from VND 2,000,000 to VND 6,000,000 for any of the following acts:*

a) Failing to notify in writing the content of the beauty and modeling contest program to the competent state authority where the contest is held as per regulations;

b) Allowing contestants who do not meet the conditions as per regulations to participate in the beauty and modeling contests.

4. Fines for organizing beauty and modeling contests without a permit as follows:

a) From VND 20,000,000 to VND 30,000,000 for organizing provincial, sectoral, or central union beauty and modeling contests;

b) From VND 30,000,000 to VND 40,000,000 for organizing regional beauty contests;

c) From VND 40,000,000 to VND 50,000,000 for organizing national or international beauty and modeling contests in Vietnam.
