Which Agency Performs the Inspection Function of Information and Communications?

According to the provisions of Decree 140/2013/ND-CP, the inspection of Information and Communications falls under the functions of the following agencies:

State inspection agencies:

- Inspectorate of the Ministry of Information and Communications (hereinafter referred to as Ministry Inspectorate).- Inspectorate of the Department of Information and Communications (hereinafter referred to as Department Inspectorate).

Agencies assigned to perform specialized inspection functions:

- Radio Frequency Department; Telecommunications Department; Broadcasting, Television, and Electronic Information Department; Press Department; Publishing, Printing and Distribution Department (hereinafter collectively referred to as Departments assigned to perform specialized inspection functions).- Regional Radio Frequency Centers.

Additionally, Decree 140 also stipulates the forms of Information and Communications inspection as follows:

- Inspection activities are carried out in the form of planned inspections, regular inspections, and ad-hoc inspections.- Planned inspections are conducted according to approved plans.- Ad-hoc inspections are conducted when an agency, organization, or individual is found to have signs of legal violations, upon request for resolving complaints or denunciations, or as assigned by the head of a competent state management agency.- Regular inspections are carried out based on the functions and tasks of the Departments assigned to perform specialized inspection functions.
