What documents are required when individuals exit Vietnam and carry foreign currencies in cash?

This is an important content of Circular No. 20/2019/TT-NHNN of the State Bank of Vietnam amending a number of Articles of Circular No. 35/2013/TT-NHNN dated December 31, 2013 guiding implementation of a number of regulations on anti-money laundering.

Specifically, Circular No. 20/2019/TT-NHNN of the State Bank of Vietnam supplements the provision that when individuals, including residents and non-residents, enter or exit Vietnam and carry foreign currencies in cash, Vietnamese dong in cash, precious metals and/or precious stones requiring customs declaration, they shall present the following documents to customs authorities at border checkpoints:

Firstly, for precious metals and precious stones (excluding gold):

- Invoices of enterprises or organizations permitted to trade precious metals and/or precious stones; or other documents proving the legal origin of the precious metals and precious stones if such invoices are not available;

- The documents presented to customs authorities at border checkpoints must be the authentic copies or certified true copies according to regulations of laws;

Secondly, for foreign currencies in cash, Vietnamese dong in cash and gold, the documents presented to customs authorities at border checkpoints are stipulated by the State Bank;

Thirdly, if an invoice or a document proving the origin is in a foreign language:

- For individuals exiting Vietnam: a certified Vietnamese translation as prescribed by law, unless the individual has presented the authentic copy or certified true copy earlier;

- For individuals entering Vietnam: the authentic copy or certified true copy.

Besides, according to Article 9 of Circular No. 35/2013/TT-NHNN, the value of precious metals, gems (other than gold): 300,000,000 (three hundred million) dong, in which:

- Precious metals (other than gold) include: Silver, platinum, crafts and jewelry made of silver, platinum; kinds of alloy containing silver, platinum.

- Gems include: diamond, ruby, sapphire and emerald.

The value of foreign currency in cash, Vietnam currency in cash, gold required customs declaration shall comply with regulations of the State bank of Vietnam.
