What Constitutes an Act of Corruption?

At the 6th session of the 14th National Assembly, the National Assembly officially passed the 2018 Anti-Corruption Law.

The 2018 Anti-Corruption Law has enumerated acts of corruption both within and outside the State sector committed by persons holding positions and powers within State agencies, organizations, and units. To be specific:

Within the State Sector:

- Embezzlement of assets;- Receiving bribes;- Abusing positions and powers to misappropriate assets;- Abusing positions and powers while performing duties for personal gain;- Overreaching authority while performing duties for personal gain;- Exploiting positions and powers to influence others for personal gain;- Falsification in operations for personal gain;- Offering bribes, mediating bribes to resolve affairs of the agency, organization, unit, or locality for personal gain;- Exploiting positions and powers to illegally use public assets for personal gain;- Harassment for personal gain;- Failing to perform, performing incorrectly, or incompletely performing duties for personal gain;- Exploiting positions and powers to cover for individuals violating the law for personal gain; obstructing or illegally interfering in supervision, inspection, audit, investigation, prosecution, adjudication, and execution of judgment for personal gain.

Outside the State Sector:

- Embezzlement of assets;- Receiving bribes;- Offering bribes, mediating bribes to resolve affairs of the enterprise or organization for personal gain.
