What conditions must minerals permitted for export meet?

This is important content regulated under Circular 12/2016/TT-BCT amending and supplementing certain Articles of Circular 41/2012/TT-BCT regulating the export of minerals.

Circular 12/2016/TT-BCT stipulates that in order to be eligible for export, minerals must simultaneously meet the following conditions:

- Be listed in the catalogue and meet the quality standards in Appendix 01 attached to Circular 41/2012/TT-BCT.- Have a legal origin under the following cases:

- Minerals extracted, processed from mines, points of extraction with a valid mining license, valid salvage mining license issued by competent state agencies.- Imported minerals verified by customs authorities at the import border gate as stated in the customs declaration of imported mineral goods.- Minerals confiscated and liquidated by competent state agencies.- Mineral products that have been processed from legal mineral sources as mentioned above must comply with the processing technology of the processing facility.

- For exported minerals containing thorium, uranium content equal to or greater than 0.05% by weight, apart from ensuring the above conditions, they must have a radioactive material export license from the Ministry of Science and Technology in accordance with the Law on Atomic Energy.
