Recently, the Government of Vietnam has issued Decree 133/2020/ND-CP detailing the implementation of several provisions of the Law on Execution of Criminal Judgments.
What areas in Vietnam does the organization of detention facilities include? (Illustrative image)
According to Article 6 of Decree 133/2020/ND-CP, regulations on the organization of detention facilities are as follows:
1. Prison subdivision: A prison subdivision under a detention facility is responsible for managing, detaining, educating, and rehabilitating inmates according to the policies of the Communist Party and the laws of the State.
2. Detention areas within a prison subdivision, include:
- Detention area for inmates serving sentences over 15 years, life imprisonment, and inmates classified as dangerous recidivists;
- Detention area for inmates serving sentences of 15 years or less; inmates serving sentences over 15 years who have had their sentences reduced and the remaining prison term is less than 15 years; inmates classified as dangerous recidivists who have served half of their sentence and have had their prison terms reduced.
3. Prison cells:
- General cell: Each cell houses no more than 50 inmates;
- Private cell: Each cell houses no more than 08 inmates;
- Disciplinary cell: Each disciplinary cell houses no more than 02 disciplined inmates.
4. Supporting facilities include:
- Facilities for labor, study, living, medical care, education, rehabilitation, vocational orientation, and vocational training for inmates;
- Facilities to support the work, study, living, and other conditions for officers, non-commissioned officers, soldiers, professional soldiers, police workers, and defense workers stationed at the detention facility.
5. Labor and vocational training area include
* Labor and vocational training area, including:
- Labor and vocational training areas for inmates invested, constructed, and directly managed by the detention facility;
- Labor and vocational training areas for inmates invested, constructed by organizations or individuals within the land managed by the detention facility and handed over to the detention facility for direct management and use during the cooperation period.
* Labor and vocational training areas are responsible for managing, detaining, educating, laboring, and vocational training for inmates according to the law.
* Labor and vocational training areas include the following construction items:
- Inmate detention houses built solidly to ensure security and safety as stipulated by the Ministry of Public Security and Ministry of Defense;
- Facilities for study, living, medical care, education, labor, and vocational training for inmates;
- Facilities to support the work, study, living, and other conditions for officers, non-commissioned officers, soldiers, professional soldiers, police workers, and defense workers stationed at the labor, vocational orientation, and vocational training area.
6. The agency managing criminal judgment execution under the Ministry of Public Security, the agency managing criminal judgment execution under the Ministry of Defense is responsible for managing the organizational system, staffing, and activities of the labor and vocational training area; deciding on the establishment, dissolution, merger, and management of labor and vocational training areas as specified in Clause 5, Article 6 of Decree 133/2020/ND-CP.
