What are the Requirements for Collaborators Reviewing Legal Normative Documents?

Recently, the Inspector General of the Government of Vietnam issued Circular 06/2015/TT-TTCP stipulating the review, systemization, codification, inspection, and handling of legal normative documents; monitoring the implementation of the law under the responsibility of the Government Inspectorate.

at Article 4 of Circular 06/2015/TT-TTCP, it is stipulated that collaborators involved in reviewing, systematizing, codifying, and examining legal normative documents must meet the following standards:

- Possess a level of education, legal knowledge, and understanding of one or more fields of inspection, citizen reception, complaint resolution, denunciation, and anti-corruption;

- Have experience in constructing, checking, reviewing, systematizing, and codifying legal normative documents;

- Have at least 03 years of experience in the relevant field.

However, based on the requirements of reviewing, systematizing, codifying, and examining legal normative documents, collaborators might be selected from units under the Government Inspectorate of Vietnam or other agencies and organizations. The Legal Affairs Department will compile a list of collaborators based on proposals from units under the Government Inspectorate of Vietnam and related agencies, and submit it to the Inspector General of the Government of Vietnam for a decision.

Circular 06 stipulates that legal normative documents regulated in Article 13; Clauses 1 and 2 of Article 21 of this Circular, within 03 working days from the date the document is signed and issued, the drafting unit (for documents under the authority of the Government Inspectorate of Vietnam) or the issuing agency (for documents under the authority of ministries, ministerial-level agencies, People's Councils, and provincial People's Committees) is responsible for sending 01 copy to the Government Inspectorate of Vietnam (via the Legal Affairs Department) to organize the examination.
