What are the Duties of the Council for Auction of Mineral Mining Rights in an Auction Session?

On April 14, 2014, the Minister of Natural Resources and Environment issued Circular 16/2014/TT-BTNMT on the Operational Regulations of the Mineral Exploitation Rights Auction Council.

Article 5 of Circular 16/2014/TT-BTNMT stipulates the tasks of the Auction Council as follows:

- Approving the auction regulations and rules for the mineral extraction rights auction session drafted by the Standing Committee.

- Deciding on the preliminary deposit amount and the bidding step for the auction session.

- Organizing and managing the auction session.

- Verifying and presenting the auction results of the mineral extraction rights to the competent state management authority for licensing approval.

- Handling violations occurring during the auction session; supervising the auction (in cases where a professional auction organization is hired).

- Addressing complaints and denouncements during the implementation of the mineral extraction rights auction session.

In addition, each member of the Auction Council has the following responsibilities and authorities:

- During the performance of tasks, compliance with the auction session rules and auction regulations is required.

- Perform tasks assigned by the Chairman of the Auction Council in accordance with the required demands and stipulated time.

- Timely reporting to the Chairman of the Auction Council about any violations or suspicious signs during the duty performance to take necessary measures.

- Be accountable to the Chairman of the Auction Council and to the law for the assigned tasks.

- Attend meetings and auction sessions for mineral extraction rights organized by the Auction Council; discuss and vote on issues raised in the meetings or auction sessions, or provide written opinions.

- Be provided with related auction documents and have the right to request detailed information or clarifications from the Standing Committee of the Auction Council.

- Have the right to suggest that opinions be recorded in documents related to the mineral extraction rights auction.
