On July 16, 2013, the Government of Vietnam promulgated Decree 35/2009/ND-CP on the organization and operation of the Inspectorate of Natural Resources and Environment.

Article 15 of Decree 35/2009/ND-CP specifically stipulates the duties and powers of the Chief Inspector of the Department of Natural Resources and Environment in Vietnam as follows:
1. Lead and direct inspection activities within the management scope of the Department of Natural Resources and Environment.
2. Develop inspection programs and plans to submit to the Director of the Department of Natural Resources and Environment for decision and organize the implementation of these programs and plans.
3. Submit to the Director of the Department of Natural Resources and Environment for issuance of inspection decisions when detecting signs of legal violations.
4. Submit to the Director of the Department of Natural Resources and Environment for decision or make decisions within their jurisdiction on the establishment of Inspection Teams, the appointment of Inspectors, and the mobilization of Inspection Collaborators to conduct inspections according to legal regulations.
5. Recommend the Director of the Department of Natural Resources and Environment to temporarily suspend the execution of decisions made by heads of units within the management scope of the Department of Natural Resources and Environment when there is a basis to believe that these decisions are illegal or affect inspection activities; recommend the Director of the Department of Natural Resources and Environment consider the responsibility and handle individuals with violations under the management scope of the Department of Natural Resources and Environment.
6. Impose administrative penalties according to regulations on handling administrative violations.
7. Recommend the Director of the Department of Natural Resources and Environment resolve issues regarding inspection activities; in cases where such recommendations are not accepted, report to the Chief Inspector of the province, and simultaneously report to the Chief Inspector of the Ministry of Natural Resources and Environment.
8. Perform other duties and powers as prescribed by law.
