Vietnam: Tet Lunar New Year holiday schedule for the Year of the Rooster 2017

According to Point b Clause 1 Article 115 of the Labor Code 2012 of Vietnam, employees are entitled to a 5-day holiday with full pay during the Lunar New Year.

Employers can choose the Lunar New Year holiday period to be either 1 day at the end of the lunar year and 4 days at the beginning or 2 days at the end of the lunar year and 3 days at the beginning. Additionally, employers must notify the employees of the Lunar New Year holiday plan at least 30 days before implementation (Article 8 of Decree 45/2013/ND-CP of Vietnam's Government).

Since the 1st and 2nd days of January of the Year of the Rooster fall on Saturday and Sunday, the Lunar New Year holiday of 2017 will be applied as follows:

- For employees working at establishments with a one-day-off-per-week policy (Sunday off), they are entitled to 6 consecutive days off:

+ From the 30th of the last month of the Year of the Monkey to the 5th of the first month of the Year of the Rooster (i.e., from January 27 to February 1, 2017); or

+ From the 29th of the last month of the Year of the Monkey to the 4th of the first month of the Year of the Rooster (i.e., from January 26 to January 31, 2017).

- For employees working at establishments with a two-day-off-per-week policy (Saturday and Sunday off), they are entitled to 7 consecutive days off:

+ From the 30th of the last month of the Year of the Monkey to the 6th of the first month of the Year of the Rooster (i.e., from January 27 to February 2, 2017); or

+ From the 29th of the last month of the Year of the Monkey to the 5th of the first month of the Year of the Rooster (i.e., from January 26 to February 1, 2017).- For officials and public employees:

Annually, the Government of Vietnam issues specific documents regarding the Lunar New Year holiday for officials and public employees. However, as of now, there has been no official document regulating the Lunar New Year holiday schedule for 2017.
