On July 1, 2024, the Government of Vietnam issued Decree 78/2024/ND-CP detailing some articles of the Price Law 2023 on appraisal.

Procedures for issuing or reissuing a certificate of eligibility for providing appraisal services from July 1, 2024

Article 6 of Decree 78/2024/ND-CP stipulates the procedures for issuance and re-issuance of certificates of eligibility for appraisal service business as follows:

Enterprises applying for issuance or re-issuance of certificates of eligibility for appraisal service business are responsible for performing the following tasks:

- Prepare the dossier as prescribed in Article 5 of Decree 78/2024/ND-CP, ensuring it is complete, accurate, and legal, and submit it to the Ministry of Finance by one of the following methods: postal service, direct submission, or online public service. In case of re-issuance, the enterprise must send the dossier to the Ministry of Finance within 10 days from the date the certificate is lost, torn, or the information changes compared to the information on the certificate;

- Pay the appraisal fee for issuing the certificate of eligibility for appraisal service business according to the law on fees and charges immediately upon submitting the application for issuance or re-issuance, and the fee is non-refundable.

Within 15 days from the date of receiving a complete dossier according to Clause 1, Article 6 Decree 78/2024/ND-CP:

- If the dossier is incomplete or contains inaccurate information, the Ministry of Finance will instruct the enterprise to supplement and complete the dossier in writing or through online public services. The enterprise must supplement and complete the dossier and send it to the Ministry of Finance within 10 days from the date the Ministry of Finance provides the supplement instructions. Submission of the supplementary dossier follows the methods specified in point a, Clause 1, Article 6 of Decree 78/2024/ND-CP. If the enterprise fails to supplement the dossier within this time, the Ministry of Finance will notify the enterprise of the non-issuance or non-reissuance in writing or through online public service;

- If the dossier shows that the enterprise does not meet the conditions for issuance or re-issuance, the Ministry of Finance will notify the enterprise of the reasons for non-issuance or non-reissuance in writing or through online public service;

- If the dossier shows the enterprise meets the conditions for issuance or re-issuance, the Ministry of Finance will issue, re-issue the certificate of eligibility for appraisal service business according to Form No. 06 provided in the Appendix attached to Decree 78/2024/ND-CP.

In the case where the enterprise requests re-issuance solely because the certificate is lost or torn, within 05 working days from the date of receiving a complete dossier according to Clause 1, Article 6 of Decree 78/2024/ND-CP, the Ministry of Finance will re-issue the certificate of eligibility for appraisal service business according to Form No. 06 provided in the Appendix attached to Decree 78/2024/ND-CP.

Decree 89/2013/ND-CP and Decree 12/2021/ND-CP amending and supplementing several articles of Decree 89/2013/ND-CP will become invalid from July 1, 2024.
