Vietnam: List of State secrets classified as “confidential” of the Finance sector

The list of State secrets classified as “confidential” of the Finance sector includes news, documents and data within the following scope:

1. Documents and statistics of Vietnam's foreign aid that have not been published.

2. The State budget plan that is being submitted to the competent authority before the National Assembly decides.

3. Negotiation plans and related documents for preparing for negotiations and preparing for agreements signed between Vietnam and foreign countries on financial cooperation related to debt settlement, debt restructuring, debt trading; negotiation plans on import and export duties, financial services, customs in the negotiation of Free Trade Agreements (FTAs); Double Taxation Agreements and international agreements with tax provisions that have not been published; information exchanged about taxpayers related to tax evasion, trade fraud between the competent authorities under the Double Taxation Agreements between Vietnam and countries and territories, or international agreements with tax provisions.

4. Network system and protection plan for state reserve warehouses; vaults, precious metals, and gems of the state treasury system; documents on technical standards and vault design; plans for transporting money and relocating vaults of the State Treasury system; precious metal and gemstone records managed and preserved by the State Treasury; gold and silver payment records.

5. Absolute aggregate data on the quantity and value of annual state reserve supplies and goods.

6. Summary of annual absolute plans on state reserves; compile absolute data on materials and goods imported and exported every year.

7. Inventions, patents, utility solutions, and important professional secrets in the preservation of state reserve materials and goods that have not been published.

8. Price plans for special products, prices for goods under State management under the authority of the Government, the Prime Minister that have not been published; reports to the Prime Minister on the direction of price management of important goods and services in each period that have not been published.

9. Documents on equipment, weapons, technical equipment, professional equipment, and weak equipment in the customs field that have not been published or not published.

10. Documents on the communication network diagram, frequencies, and communication conventions of the customs anti-smuggling force.

11. Case files handled by professional units of the customs force that have not been published.

12. News, documents, and coordination plans between the customs and tax forces with relevant sectors in the customs and tax fields that have not been published or not published.

13. Contents and documents related to the implementation of customs control measures, drug control, counterterrorism, training of professional dogs in the prevention of smuggling, and illegal transportation of goods across borders; data and documents related to customs control work.

14. Information and documents transferred to Vietnam by foreigners or international organizations related to the fight against smuggling, illegal transportation of goods across borders; combating the smuggling and illegal transportation of drugs; the training process and use of professional dogs; combating counterfeit goods and the implementation of intellectual property protection in the customs field; combating terrorism, money laundering, and other customs law violations that are not to be published at the request of the transferring party.

15. Information about the whistleblower, the provider of information; documents and evidence provided by the provider of information related to violations of tax, customs and securities laws.

16. Information and documents with signs of violations that are being collected, analyzed, and summarized as a basis for proposing a decision to conduct post-customs inspection.

17. Audit and inspection documents; audit and inspection conclusions that have not been published.

18. Information and documents on the investigation and verification of internal complaints and denunciations in the financial sector that have not been published.

19. Information and documents about complaints sent to agencies and units in the financial sector but not within the jurisdiction to be transferred to the competent authorities to resolve.

20. Personnel files of the financial sector; documents on planning, appointment, reappointment, dismissal, transfer, rotation, and disciplinary action of officials that have not been published.

21. Documents on the plan to create sources for reforming the wage policy that have not been published.

22. Reports on the supervision of the activities of fund management companies; securities investment funds, payment banks, supervisory banks, custody banks and representative offices that have not been published; securities trading supervision documents that have not been published.

23. Summary information on foreign indirect investment activities; indirect capital management that has not been published.

24. News, documents, and statistics related to the management policies, stabilization of the securities market that have not been published.

25. Documents related to the restructuring process of a number of economic groups, state-owned corporations that play an important role in the economy, securities companies and exchanges that have not been published; documents related to the revenue and expenditure situation of the Central Enterprise Support Fund that have not been published.

26. Documents announcing the interest rates for the issuance of Government bonds, bonds guaranteed by the Government and local government bonds that have not been published.

27. Information about the financial sector's information system, including:

- Source code and detailed design of software applications owned by the Ministry of Finance and its units.

- Documents describing in detail the network system, information security system of units belonging to the financial sector (including construction design, connection diagrams and specific technical parameters).

- Detailed report on security vulnerabilities of the network system, servers, databases and applications currently operating on the financial sector's network.

- Passwords and authentication methods for objects accessing the financial sector's information system (excluding systems for presentation, training and testing purposes).

28. Other reports and documents using information and documents on the State secret list classified as Confidential by other agencies and organizations.

- Ordinance on State secrets protection 2000 of Vietnam effective from April 01, 2001;

- Circular No. 56/2013/TT-BCA-A81 effective from December 29, 2013.
