Regarding this matter, LawNet would like to answer as follows: 

1. Vietnam: Individuals over 70 can still participate in security and order protection at the grassroots level

According to Article 13 of the Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023, Vietnamese citizens who have the desire to join and meet the following criteria are considered for selection to join the forces participating in security and order protection at the Grassroots Level:

- Between 18 and 70 years of age; in cases where individuals are over 70 years old but still maintain good health, the Chairman of the Commune People's Committee shall consider and decide based on the proposal of the Commune-level Public Security.

- Have a clear personal history; possess good moral qualities; oneself and one's family must adhere to the Party's guidelines, the state's policies and laws; not be wanted for criminal responsibility, serving a criminal sentence in the commune, ward, town, or subject to judicial or administrative measures.

In cases where the court's judgment has been fully served, the criminal record must be expunged; when the completion of the administrative penalty decision has expired, it must be considered as not being subject to administrative measures according to the provisions of the law.

- Have a high school diploma or have completed a basic secondary education program. For border areas, islands, mountainous regions, economically and socially difficult areas, and areas with ethnic minority communities, individuals who have completed a primary education program may be selected.

- Have been residing or temporarily residing for more than 1 year and regularly living in the place where citizens submit their application to join the forces security and order protection at the Grassroots Level. In cases stipulated in Clause 3 of Article 15 of the Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023, individuals must be residing or temporarily residing in the place where they submit their application to participate in the forces security and order protection at the Grassroots Level.

- Meet the health requirements according to the medical examination and treatment certificate issued by an established medical facility in compliance with the law.

Therefore, according to the above regulations, individuals over the age of 70 can still join the forces participating in security and order protection at the Grassroots Level, but it is necessary to ensure good health, in which case the Chairman of the Commune People's Committee will consider and decide based on the proposal of the Commune Public Security.

2. Arrangement of forces participating in security and order protection at the Grassroots Level in Vietnam

Article 17 of the Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023 stipulates the arrangement of forces participating in security and order protection at the Grassroots Level as follows:

- The forces participating in security and order protection at the Grassroots Level are formed from the commune-level public security force, the sub-professionalized commune-level public security force, and the team leader, team deputy of the people's defense team, or selected individuals according to the provisions of the Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023.

- The forces participating in security and order protection at the Grassroots Level are organized into security and order protection teams. The area of responsibility of the security and order protection team is one or several hamlets or neighborhoods belonging to the administrative unit at the commune level or in districts where there is no administrative unit at the commune level.

- Based on the situation, requirements for ensuring security and order, socio-economic conditions, population scale, and natural area of the locality, the Provincial People's Council shall establish criteria for the establishment of security and order protection teams and criteria for the number of team members in the area under its management.

- The Provincial People's Committee shall decide on the number of security and order protection teams that need to be established, the number of team members in each security and order protection team in hamlets or neighborhoods within the administrative jurisdiction of each commune-level administrative unit.

- Based on the Decision of the Provincial People's Committee stipulated in Clause 4 of Article 17 of the Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023, the Chairman of the Commune People's Committee, upon the proposal of the Commune Public Security, shall decide on the establishment of security and order protection teams and the appointment of individual members to the security and order protection teams.
