Guidelines for the process of transferring to be appointed to inspection branches (Illustration)
According to Decree 97/2011/ND-CP, officials working in state inspection agencies who meet the conditions and professional standards specified in Clause 1, Article 32 of the Inspection Law and Articles 6, 7, and 8 of Decree 97 are eligible for review and transfer to positions in the inspectorate as follows:
- If the civil servant holds the position of specialist or an equivalent title, they will be reviewed and transferred to the position of inspector;
- If the civil servant holds the position of principal specialist or an equivalent title, they will be reviewed and transferred to the position of chief inspector;
- If the civil servant holds the position of senior specialist or an equivalent title, they will be reviewed and transferred to the position of senior chief inspector.
Note: The consideration and transfer to inspectorate positions must go through the Consideration and Transfer Council.
Ministers, heads of equivalent agencies, Chairpersons of People's Committees of provinces and central-affiliated cities shall decide to establish the Consideration and Transfer Council for inspectorate positions for officials under their management.
The Consideration and Transfer Council consists of 05 members, working under the principle of collective decision-making by majority vote. The composition includes:
- The Chairperson of the Council: At the central level, it's the leader of the ministry or equivalent agency; at the local level, it’s the leader of the People's Committee of province and central-affiliated city;
- The Vice-Chairperson of the Council is the Director of the Personnel Department or the Director of the Department of Home Affairs;
- The standing member is the Chief Inspector of the ministry, equivalent agency, or Chief Inspector of the province and central-affiliated city. The standing member is responsible for preparing the legal documents and reports for the Consideration and Transfer Council;
- Other members will be decided by the Minister, head of the equivalent agency, or the Chairperson of the provincial or municipal People's Committee as per requirements, including representatives from relevant agencies or units.
Application dossier for the Consideration and Transfer Council includes:
- A document evaluating the working process of the official and a recommendation from the direct management agency;
- A report on the inspection results; certified copies of diplomas and certificates by the authorized agency or confirmed by the direct management and employing agency;
- A resume following form 2C-BNV/2008 (Decision 02/2008/QD-BNV dated October 6, 2008, by the Ministry of Home Affairs on issuing the management form for official’s profiles) certified by the direct management and employing agency.
Application dossier for appointment to the position of inspector, chief inspector includes:
- Personal dossier as prescribed in clause 3 of this Article;
- The meeting minutes of the Consideration and Transfer Council;
- A document from the Consideration and Transfer Council recommending the Minister, head of an equivalent agency, or Chairperson of the province and central-affiliated city to appoint them to the position of inspector or chief inspector under their authority.
Application dossier for appointment to the position of senior chief inspector includes:
- Personal dossier as prescribed in clause 3 of this Article;
- The meeting minutes of the Review and Transfer Council;
- A recommendation document from the Review and Transfer Council for the appointment to the senior chief inspector position;
- A document from the Minister, head of an equivalent agency, or Chairperson of the province and central-affiliated city recommending the Minister of Home Affairs to appoint them under their authority.
The authority for appointing to the inspectorate positions is performed as regulated in Article 11 of Decree 97/2011/ND-CP.
