Vietnam: Application and procedures for paying advance on assessment expense

Assessment expense means necessary and reasonable amounts to be paid for assessment work which is calculated by assessment organization or individual in accordance with this Ordinance and other relevant provisions of Vietnam’s law.

An assessment-conducting organization or individual shall determine and notify the procedure-conducting agency specified in Article 6 of the Ordinance on Assessment and Valuation Expenses and Expenses for witness and interpreter in Legal Procedures of the level of advance on assessment expense and the time limit for paying this advance.

1. Procedures

In case advance of assessment expense are needed, within 05 working days since receipt of decision on soliciting assessment issued by the procedure conducting body, organizations or individuals performing assessment must submit a request for advance of assessment expense to the procedure conducting body.

2. Application

Documentation of requests for advance of assessment expense includes:

- Request form that includes name, address, tax code of organizations or individuals performing assessment; level of advance, time and method of payment.

- Tabular calculation of total expenses for assessment and grounds for calculations;

Within ten working days since receipt of documented requests for advance from organizations or individuals performing assessment, the procedure conducting body shall be responsible for carrying out consideration and making advance to such organizations or individuals.

Maximum level of advance shall not exceed assessment expense stated in the submitted request as prescribed in Clause 2 Article 7 of Decree No. 81/2014/NĐ-CP of Vietnam’s Government.

Procedure-conducting agencies shall pay advances according to notices of assessment-conducting organizations or individuals.
