Vietnam: Adjustment of science and technology contracts according to Circular 33/2014/TT-BKHCN

Recently, the Ministry of Science and Technology of Vietnam issued Circular 33/2014/TT-BKHCN promulgating the regulation on management of ministerial-level science and technology tasks of the Ministry of Science and Technology, including the adjustment of science and technology contracts.

Under Article 16 of Circular 33/2014/TT-BKHCN, the adjustment of science and technology contracts in Vietnam is specified as follows:

  1. The host unit has the authority to proactively use and decide on adjusting the budget estimates (if any) for the assigned funds according to regulations.

  2. The Minister of Science and Technology shall consider and decide on adjustments regarding: the name of the science and technology task, the host unit, the individual in charge, the performance period, the budget, and the method of contract disbursement for performing the science and technology task based on the written proposal of the host unit for ministerial-level tasks and the opinion of the Department of Planning - General Affairs.

    The adjustment of the performance period must be made before the contract expires and may only be done once, and not exceed 12 months for tasks with a performance period of 24 months or more, and not exceed 6 months for tasks with a performance period of less than 24 months. Special cases shall be decided by the Minister of Science and Technology of Vietnam.

  3. The Minister of Science and Technology shall consider, approve the policy, and authorize the Department of Planning - General Affairs to sign documents regarding the adjustment of other contents within the scope of the signed contract based on the written proposal of the host unit, excluding the contents specified in Clause 2 of this Article.

  4. In necessary cases, the Ministry of Science and Technology of Vietnam shall seek the opinions of independent experts before deciding on adjustments.
