Transfer of Military Weapons and Explosives

On May 15, 2018, the Ministry of Public Security issued Circular 17/2018/TT-BCA to stipulate the transfer of weapons and military explosives.

Circular 17 stipulates the transfer of weapons, military explosives, and support tools. This involves the collection of weapons, military explosives, and support tools from police units and localities that have been equipped to supplement other police units and localities.

The authorities responsible for the transfer include:

- The Minister of Public Security decides to transfer weapons, military explosives, and support tools from one police unit or locality to another nationwide in case of an emergency or when there is a threat to national security that has not reached the level of declaring a state of emergency, or in the event of other unexpected situations such as disasters, dangerous epidemics, floods, storms, or to meet the requirements of work and combat based on the proposal from the equipment and logistics management authorities under the Ministry of Public Security;- The Head of the equipment and logistics management department under the Ministry of Public Security decides to transfer weapons, military explosives, and support tools not specified in point (a) of this clause from one police unit or locality to another upon obtaining written consent from the Minister of Public Security;- The Head of the police unit or locality decides to transfer weapons, military explosives, and support tools between the units under their management.

Note, after a transfer decision by the competent authority, the police units and localities must make a handover record, specifying the type, quantity, quality, serial number, manufacturing country, equipment, and accompanying accessories of the transferred weapons, military explosives, and support tools. The record must bear the signatures of the officers directly handing over and receiving and the confirmation of the leaders of the involved units.

After receiving the weapons, military explosives, and support tools according to the transfer decision, the concerned police units and localities must submit a written request to the competent police authority for a usage permit and registration confirmation as stipulated.
