This content is presented in the Draft of the second round of the Residence Law 2020. The draft has eliminated specific conditions for permanent residence registration in centrally-run cities.
Removal of Special Conditions for Permanent Residence Registration in Cities (Illustration)
To be specific, at Article 21 of the Draft Residence Law 2020, certain conditions for permanent residence registration are regulated. Among those, the conditions for permanent residence registration in provinces, centrally-run cities are the same.
- Citizens with legal accommodation in any province or centrally-run city are allowed to register permanent residence at that province or centrally-run city. Except for cases stipulated in Clause 2 of this Article, citizens with legal accommodation by renting, borrowing, or staying with individuals or organizations must meet the following conditions:
- The tenant, borrower, or temporary resident must obtain the consent from the landlord, lender, or host for permanent residence registration at the rented, borrowed, or temporary residence;
- Ensure the conditions regarding average living space as prescribed by the People's Council of the province or centrally-run city; with a confirmation from the commune-level People's Committee on the average living space conditions.
- Citizens are permitted to register permanent residence in any province or centrally-run city upon the homeowner's consent in the following cases: Wife living with husband; husband living with wife; child living with parents; parents living with child; retirees, those who have reached the end of working age, those who are unemployed, living with siblings; disabled individuals, those incapable of working, those with mental illnesses or other diseases that render them incapable of cognition or behavior control, living with siblings, aunts, uncles, guardians; minors with parental consent or without parents living with grandparents, siblings, aunts, uncles, guardians; single adults living with grandparents, siblings, aunts, uncles; grandparents living with grandchildren.
Thus, according to the new Draft, the specific conditions for permanent residence registration in provinces, centrally-run cities are removed. Residents without household registration can still live and work normally, without affecting social services.
