Time Limit for Payment of Benefits Upon Termination of Labor Contract

the Government of Vietnam has officially issued Decree 148/2018/ND-CP specifying the time limit for payment of benefits upon termination of employment contracts.

Decree 148 stipulates that within 07 working days, from the date of termination of the labor contract, the employer and the employee are responsible for fully settling the amounts related to the rights and benefits of each party. In special cases, the payment period may be extended but must not exceed 30 days from the date of termination of the labor contract, in one of the following cases:

- The employer, who is not an individual, ceases operation;- The employer or employee encounters natural disasters, fires, enemy attacks, or dangerous infectious diseases;- The employer undergoes restructuring, changes in technology or for economic reasons, or merger, acquisition, division, separation of the enterprise, cooperative, transfer of ownership, or right to use assets.
