The Title of the Vietnamese Document Translated into English in the Style of a Legal Document: "Conditions for Acknowledgment and Guidance of Internship for Bailiff Offices"

On August 28, 2020, the Ministry of Justice issued Circular 05/2020/TT-BTP to provide guidance on Decree 08/2020/ND-CP regarding the organization and operations of Judicial Officers.

Enforcement Officer Office must meet the following conditions to accept, guide internship (Illustrative image)

According to Article 9 of Circular 05/2020/TT-BTP, the Enforcement Officer Office must meet the following conditions to accept, guide internship:

  1. The Enforcement Officer Office accepting the internship must have an Enforcement Officer who meets the conditions for guiding an internship as stipulated in item 2 below.

  2. The guiding Enforcement Officer must have at least 02 years of experience in practicing as an Enforcement Officer. An Enforcement Officer who has been administratively sanctioned in their professional activities can guide an internship 01 year after the date of completing the administrative sanction decision. At any given time, an Enforcement Officer cannot guide more than 03 interns.

  3. An Enforcement Officer must refuse to guide an internship if they do not meet the conditions stipulated in clause 2 of this Article; as stipulated in points a and b, clause 1, Article 10 of Circular 05/2020/TT-BTP; if they are temporarily suspended from practicing as an Enforcement Officer; or for health reasons or other objective reasons.

An Enforcement Officer who refuses to guide an internship according to this clause must notify in writing the Enforcement Officer Office accepting the internship. The accepting Enforcement Officer Office must assign another qualified Enforcement Officer to guide the internship; if there is no other qualified Enforcement Officer in the office, a written notification must be sent to the Department of Justice. Within 07 working days from the date of receiving the notification from the Enforcement Officer Office, the Department of Justice must designate another Enforcement Officer Office to accept the internship; if no Enforcement Officer Office meets the conditions to accept the internship, a written notification with a clear explanation must be sent to the intern.
