The representative of the enterprise for labor leasing must not have a criminal record

This content is stipulated in Decree 29/2019/ND-CP detailing the implementation of Clause 3, Article 54 of the Labor Code regarding the issuance of licenses for labor leasing activities, the deposit requirements, and the list of jobs eligible for labor leasing.

According to the provisions of Decree 29/2019/ND-CP, the legal representative of an enterprise engaging in labor outsourcing activities must not have a criminal record. Additionally, they must meet the following conditions:

- Be a manager of the enterprise;- Have no criminal record;- Have worked in the field of labor outsourcing or labor supply for at least 03 years (36 months) within the 05 years immediately preceding the application for a license.

Moreover, to obtain a labor outsourcing operations license, the enterprise must deposit VND 2,000,000,000 in a commercial bank or a legally established and operational foreign bank branch in Vietnam. The duration of the license is stipulated as follows:

- The maximum duration of the license is 60 months;- The license may be renewed multiple times, with each renewal lasting a maximum of 60 months;- The duration of the reissued license is equal to the remaining duration of the previously issued license.
