Recently, the Ministry of Culture, Sports, and Tourism issued Circular 04/2020/TT-BVHTTDL stipulating measures for implementing the state management function regarding the formulation and execution of conventions and agreements.
Procedure for recognizing customary laws and regulations issued by the Ministry of Culture, Sports, and Tourism (illustration)
As stipulated in Article 4 of Circular 04/2020/TT-BVHTTDL, the procedure for recognizing customary laws and regulations is as follows:
- After receiving the report from the village head or the head of the residential group's executive board on the results of the village or residential group's community meeting and vote to approve the customary laws and regulations, the commune-level official for Culture and Society will take the lead and cooperate with the commune-level official for Justice and Civil Status to advise and assist the commune-level People's Committee in compiling a dossier to be sent to the district-level People's Committee (through the Office of Culture and Information) to request the recognition of the customary laws and regulations.
The official dispatch requesting the recognition of customary laws and regulations should follow Form No. 01 in the Appendix issued with this Circular.
- After receiving the complete dossier requesting the recognition of customary laws and regulations from the commune-level People's Committee, the Office of Culture and Information will take the lead and cooperate with the Office of Justice to gather opinions from relevant agencies and units to submit to the district-level People's Committee for recognition or non-recognition of the customary laws and regulations.
The decision to recognize the customary laws and regulations should follow Form No. 02 in the Appendix issued with Circular 04/2020/TT-BVHTTDL.
