This is currently a matter of concern for many people with numerous questions. So, in reality, according to current regulations, is the maternity leave period of teachers counted towards regular salary grade consideration?

According to the provisions at Point a, Clause 1, Article 2 of Circular 08/2013/TT-BNV, the conditions for maintaining salary grades for regular salary raise are stipulated as follows:
- For the title of senior specialist: If the final salary grade in the senior specialist salary table has not been reached, after 5 years (a full 60 months) maintaining the salary grade in the senior specialist salary table, a salary grade raise will be considered;
- For ranks and titles requiring education from college level and above: If the final salary grade in the rank or title has not been reached, after 3 years (a full 36 months) maintaining the salary grade in the rank or title, a salary grade raise will be considered;
- For ranks and titles requiring education from intermediate level and below, and executive, service employees: If the final salary grade in the rank or title has not been reached, after 2 years (a full 24 months) maintaining the salary grade in the rank or title, a salary grade raise will be considered.
Additionally, according to Point b, Clause 1, Article 2 of Circular 08/2013/TT-BNV, the following periods are counted towards the time to consider a regular salary raise, including:
- Time off work with full pay as prescribed by labor law;
- Time off enjoying maternity policies as prescribed by social insurance law;
- Time off for illness, work-related accidents, or occupational diseases enjoying social insurance cumulatively from 6 months or less (during the time of maintaining the salary grade) as prescribed by social insurance law;
- Time designated by competent authority for going to work as a specialist, studying, interning, working, or surveying domestically or abroad (including time accompanying a spouse as per the regulations of the Government of Vietnam) but still on the payroll of the agency or unit.
Thus, the time public employees, including teachers, take off to enjoy maternity policies as prescribed by social insurance law will be counted towards the time to consider a regular salary raise.
