Regarding this matter, LawNet would like to answer as follows: 

On May 18, 2024, the Government issued Decree 56/2024/ND-CP amending Decree 55/2011/ND-CP on the functions, tasks, powers, and organizational structure of the regulatory organization in Vietnam.

Tasks and powers of the regulatory organization in government agencies as of July 2, 2024 in Vietnam

The tasks and powers of the regulatory organization in government agencies in Vietnam are as follows:

(1) Regarding the work of law construction and the development of internal regulations and rules of the agency:

Take the lead and coordinate with relevant units to advise and assist the Head of the government agency in:

  - Developing, amending, supplementing, or providing feedback on draft internal regulations and rules of the government agency and other documents as assigned by the Head of the government agency;

  - Giving opinions on proposals, projects, and draft legal normative documents submitted for opinions as assigned by the Head of the government agency;

  - Proposing to competent state agencies the issuance, amendment, supplementation of legal normative documents related to the government agency.

(2) Provide legal opinions on documents and contracts prepared by other units as assigned by the Head of the government agency.

(3) Regarding the work of inspecting legal normative documents:

- Coordinate with the regulatory organization of the ministry, cross-ministry agencies managing the fields and sectors of the government agency to inspect legal normative documents in the fields and sectors of the government agency.

(4) Regarding the work of legal dissemination and education:

- Take the lead and coordinate with relevant units to advise and assist the Head of the government agency in coordinating with the Ministry of Justice to implement state management on legal dissemination and education;

- Take the lead and coordinate with relevant units to advise and assist the Head of the government agency in implementing tasks related to legal dissemination and education within the scope of the industry and sector as prescribed by law.

(5) Regarding the work of state compensation:

- Take the lead and coordinate with relevant units to advise and assist the Head of the government agency in coordinating with the Ministry of Justice to implement state management on state compensation;

- Take the lead and coordinate with relevant units to advise and assist the Head of the government agency in implementing tasks related to state compensation within the scope of the industry and sector as prescribed by law.

(6) Regarding the monitoring of law enforcement:

Take the lead and coordinate with relevant units to advise and assist the Head of the government agency in monitoring the enforcement of laws in the assigned field as prescribed by law.

(7) Regarding the management of law enforcement on administrative violation handling:

The regulatory organization of the Social Insurance of Vietnam takes the lead and coordinates with relevant units to implement the management of law enforcement on administrative violation handling within the scope of management as prescribed by law.

(8) Provide guidance and conduct inspections on expertise and professional competence in regulatory work for regulatory organizations and personnel working in regulatory work in subordinate units.

(9) Perform other tasks assigned by the Head of the government agency or as prescribed by law.
