Standards for rank-surpass promotion of general army rank in the army; new regulations on tasks of teachers and homeroom teachers; new regulations on requirements for driving license exchange; etc., are notable contents that will be covered in this bulletin.

Vietnam’s standards of rank-skip promotion to general rank in the army

On March 3, 2025, the Government of Vietnam promulgated Decree No. 59/2025/ND-CP on standards and criteria for rank-skip and premature promotion to general rank for officers of the People’s Army of Vietnam, effective as of March 3, 2025. 

According to the Decree, a commissioned officer with a current rank lower than the highest rank of his/her current position or title (general rank) from 2 grades or more achieving exceptionally outstanding achievements shall be considered for rank-skip promotion when he/she receives one of the following commendation forms: 

- Orders: Gold Star Order, Ho Chi Minh Order, first-class Independence Order, first-class Military Exploit Order, first-class Labor Order, first-class Fatherland Defense Order, or first-class Feat Order; 

- Honorary titles of the state: People’s Armed Forces Hero or Labor Hero;

- Ho Chi Minh Prize.

The commissioned officer shall be assessed after the commendation decision is issued. 

Unprescribed special cases shall be considered and decided by competent authorities. 

Vietnam’s new regulations on tasks of teachers and homeroom teachers 

On March 7, 2025, the Minister of Education and Training of Vietnam promulgated Circular No. 05/2025/TT-BGDDT on working regulations applicable to general and pre-university teachers, which stipulates regulations on teachers’ annual breaks (effective as of April 22, 2025). 

According to the Circular, the tasks of teachers and homeroom teachers are as follows: 

- Teachers’ tasks shall comply with the charters, operational and organizational regulations by each learning level and educational institution, and regulations on tasks by each professional title of competent authorities.

- Tasks of homeroom teachers of primary schools, specialized schools, and other educational institutions implementing primary education programs shall comply with the charters of primary schools. 

- Tasks of homeroom teachers of lower secondary schools, higher secondary schools, multi-level general schools, specialized schools, and other educational institutions implementing lower secondary, higher secondary, and pre-university education programs: 

+ Carry out teachers’ tasks as per regulation; 

+ Proactively grasp the information on students of assigned classes; develop and organize classes' operational plans of such classes and students; organize class activities; 

+ Closely cooperate with parents, guardians, subject teachers, Ho Chi Minh Communist Youth Union, Ho Chi Minh Young Pioneer Organization, trade unions, and other relevant social organizations in organizing educational activities and supporting and supervising the learning and training activities of students of assigned classes; summarize comments and assessments on students at the end of term I and at the end of the academic year; provide instructions for students to engaging in voting and commendation requests; formulate lists of students recommended to move up to the next grade, students who are ineligible for moving up to the next grade, and students who must undergo training in the summer vacation; complete the school reports; 

+ Instruct and manage students participating in experiential activities, educational activities, and training activities organized by schools; 

+ Submit periodic or irregular reports on the situations of classes to the principals

Vietnam’s new regulations on requirements for driving license exchange 

On February 28, 2025, the Minister of Public Security of Vietnam promulgated Circular No. 12/2025/TT-BCA on tests and issuance of driving licenses; issuance and use of international driving licenses, effective as of March 1, 2025. 

- Vietnamese and foreigners eligible for tests and issuance of driving licenses in Vietnam: 

- People with driving licenses damaged to the point of being unusable; 

- Vietnamese and foreigners with permanent residence cards in Vietnam with Vietnamese driving licenses converted from foreign driving licenses may exchange their driving licenses when such driving licenses expire or if needed; 

- Where the date, last name, name, middle name, nationality, place of birth, or place or residence on a driving license is different from the identity card or identification, competent authorities shall carry out the procedure for exchanging a new driving license, conformable with the information prescribed in the identity card or identification; 

- People who wish to integrate their indefinite driving licenses with definite driving licenses; 

- The following cases shall not be eligible for driving license exchange: the person requesting the driving license exchange does not possess the issued driving license, and the information on the driving license is not present in the driving license information system of the Traffic Police Department or the list of driving license issuance (management book); the person violating traffic order and safety regulations has yet to fulfill the request of a competent state authority regarding the settlement and handling of the administrative violation against traffic order and safety regulations. 

4 steps in audit process of State Audit Office of Vietnam 

On March 3, 2025, the Auditor General of the State Audit Office of Vietnam promulgated Decision No. 10/2025/QD-KTNN on the audit process of the State Audit Office of Vietnam, effective as of April 17, 2025. 

According to the Decision, the audit process of the State Audit Office of Vietnam (hereinafter referred to as “audit process” stipulates the procedure for implementing the work of an audit session carried out by the State Audit Office of Vietnam.  The audit process is developed based on the Law on State Audit Office of Vietnam 2015, the system of state audit standards, and the actual audit operations. 

The audit process includes 4 steps: 

- Audit preparation; 

- Audit implementation; 

- Formulation and submission of audit reports; 

- Monitoring and inspection of audit conclusions and suggestions. 

In audit operations, if there are cases arising unprescribed by the regulations of this audit process, heads of audit delegations, heads of audit teams, members of audit delegations, and organizations and individuals authorized or hired to carry out the audit shall submit reports to the head auditors or directors of units assigned to take charge of audit sessions (head auditors) to request for feedback from the Auditor General of the State Audit Office of Vietnam for consideration and decision.
