Support for Occupational Change for Employees Who Suffer from Occupational Accidents When Returning to Work

Decree 88/2020/ND-CP stipulates that employers shall be supported with vocational training funds for occupational transition for employees. Specifically:

Conditions for supporting vocational transition for employees suffering from occupational accidents or diseases when returning to work

- Experiencing a reduction in labor capacity of 31% or more due to occupational accidents or diseases;- Being arranged by the employer to a new job under the management domain, suitable to the health and aspiration of the employee, but that job requires vocational training for transition;- Participating in occupational accident and disease insurance in accordance with the law at the time of the occupational accident or disease.

Levels and authority to decide vocational transition support

The Department of Labor, War Invalids, and Social Affairs decides support for each individual as follows:

- The maximum support level is 50% of the tuition fee, but not exceeding 15 times the statutory pay rate;- The maximum number of supports for each employee is two times, and in one year, only one support can be received.

Note: The tuition fee is calculated based on the vocational training service price regulated by competent state agencies.

Documents required to propose vocational transition support include:

  1. A document from the employer proposing vocational training funds support for employees suffering from occupational accidents or diseases.
  2. A certified copy of the medical evaluation council’s report assessing the reduction in labor capacity.
  3. A certified copy of payment receipts for training costs as prescribed.
