This is the content stipulated in Decree 31/2019/ND-CP detailing certain articles and measures for the implementation of the Law on Denunciations.
In the following cases, the head of the superior agency or organization must resolve the denunciation cases under the authority of the subordinate agency or organization:
- When there are grounds to determine that the resolution of denunciations by the subordinate agency or organization has serious legal violations:- Violations of the procedure and process for resolving denunciations, leading to inaccurate and objective conclusions or altering the case files;- Having one of the grounds specified in Clause 3, Article 37 of the Law on Denunciations.
- When there are signs of a lack of objectivity in the resolution of denunciations by the subordinate agency or organization:- The accused is the spouse, biological parent, adoptive parent, parent-in-law, child, adopted child, son-in-law, daughter-in-law, biological sibling of the person assigned to verify the denunciation contents, or of the person resolving the denunciation;- The denunciation contents are directly related to the spouse, biological parent, adoptive parent, parent-in-law, child, adopted child, son-in-law, daughter-in-law, biological sibling of the person assigned to verify the denunciation contents, or of the person resolving the denunciation;- The person assigned to verify the denunciation contents or the person resolving the denunciation has a direct interest related to the accused.
