Subjects and conditions for receiving social pension in Vietnam from July 1, 2025

Below are the provisions specifying the subjects and conditions for receiving social pension in Vietnam according to the Law on Social Insurance 2024.

Law on Social Insurance 2024 passed by the 15th National Assembly of the Socialist Republic of Vietnam, 7th session on June 29, 2024 which comes into force in Vietnam from July 1, 2025.

Subjects and conditions for receiving social pension in Vietnam

According to Article 21 of the Law on Social Insurance 2024, the subjects and conditions for receiving social pension in Vietnam are stipulated as follows:

- Vietnamese citizens are entitled to social pension when they meet the following conditions:

+ From 75 years old and above;

+ Not receiving a monthly pension or social insurance benefits, except for other cases as regulated by the Government of Vietnam;

+ A written request for receiving social pension.

- Vietnamese citizens from 70 years old to under 75 years old who belong to poor households, near-poor households and meet the conditions specified at points b and c, clause 1 of this Article shall be entitled to social pension.

- The Standing Committee of the National Assembly decides to gradually reduce the age for receiving social pension based on the proposal of the Government of Vietnam in line with the economic-social development conditions and the state's budget capabilities in each period.

- The Government of Vietnam shall stipulate in detail clause 2 of Article 21 of the Law on Social Insurance 2024.

Policies, order, and procedures for implementing social pension in Vietnam from July 1, 2025

According to Article 22 of the Law on Social Insurance 2024, the policies, order, and procedures for implementing social pension  in Vietnam are regulated as follows:

- The monthly social pension benefit level is determined by the Government of Vietnam, commensurate with the economic-social development conditions and the state budget's capacity in each period. Every 3 years, the Government of Vietnam reviews and considers adjusting the social pension benefit level.

Depending on the economic-social conditions, budget balance capacity, and mobilization of social resources, the provincial People's Committee shall submit to the same-level People's Council for a decision to provide additional support for people receiving social pension.

- In case the subjects specified in Article 21 of the Law on Social Insurance 2024 concurrently qualify for monthly social assistance benefits, they shall be entitled to the higher benefit policy.

- Persons currently receiving monthly social pension shall have their health insurance premiums paid by the state budget in accordance with the health insurance law, and upon their death, the organization or individual responsible for their funeral shall receive funeral cost support according to the law on elderly people.

- The Government of Vietnam shall stipulate the order and procedures for implementing social pension.

Order and procedures for implementing policies for workers not eligible for pensions and not yet eligible for social pension in Vietnam

- The subjects specified in clause 1 of Article 23 of the Law on Social Insurance 2024 shall submit a dossier to the social insurance agency. The dossier includes:

+ Social insurance book;

+ A written request for receiving monthly benefits.

- Within 05 working days from the date of receipt of the complete dossier as prescribed in clause 1 of this Article, the social insurance agency is responsible for processing; if not processed, a written reply stating the reason is required.
