Recently, the Government of Vietnam has signed and promulgated Decree 81/2015/ND-CP regulating the disclosure of information by state-owned enterprises.

As stipulated in Article 7 of Decree 81/2015/ND-CP, in cases where the information disclosure cannot be executed on time due to force majeure reasons, state-owned enterprises must report to the state ownership representative agency and must promptly disclose the information once the force majeure event is resolved.
In this context, "Force majeure case" is understood as circumstances where the state-owned enterprise cannot control the occurrence of these events or cannot establish reasonable measures to prevent them from happening or to mitigate the damage when they occur.
This Decree mandates that the postponement of information disclosure must be published on the enterprise's information disclosure medium (Portal or website, other publications), and at the same time, the enterprise must report the reasons for the postponement to the state ownership representative agency. The enterprise must send a notice requesting the postponement of information disclosure to the state ownership representative agency no later than five (05) working days after the force majeure event arises.
Furthermore, the state ownership representative agency must review, evaluate, and accept the postponement of information disclosure within five (05) working days from the time of receiving the enterprise's request for postponement of information disclosure and notify the Ministry of Planning and Investment for overall monitoring and supervision.
