State Management of the Protection of National Defense Works and Military Zones

To be specific:, according to the content in Chapter 3 of the Ordinance on Protection of National Defense Works and Military Zones 1994, these regulations are as follows:

1. The Government of Vietnam shall exercise unified State management over the protection of national defense works and military zones, with the following duties and powers:

- Directing the formulation of plans and socio-economic development plans in association with the construction and protection of national defense works and military zones;- Directing and approving general planning, ensuring budget, material, and technical facilities for the management and protection of national defense works and military zones;- Guiding the compulsory purchase or requisition with compensation of assets of individuals or organizations according to the provisions of law in cases such as the need to protect national defense works and military zones and for the benefit of the nation;- Issuing legal documents on the management and protection of national defense works and military zones;- Inspecting and examining the management, use, and protection of national defense works and military zones.

2. The Ministry of Defense is directly tasked by the Government of Vietnam with the State management over the protection and use of national defense works and military zones, with the following duties and powers:

- Developing legal projects on the management, protection, and use of national defense works and military zones; promulgating regulations on the management, protection, and use of national defense works and military zones within its jurisdiction.- Organizing propaganda and education for cadres, soldiers, workers, and public employees in the defense sector to strictly comply with regulations on the protection and use of national defense works and military zones.- Organizing the management, protection, use, and inspection, and inspection of the management, protection, and use of national defense works and military zones.- Handling violations regarding the management, protection, and use of national defense works and military zones within its jurisdiction.

3. The Ministry of Home Affairs, Ministries, ministerial-level agencies, and agencies under the Government of Vietnam, according to their functions, have the following duties and powers:

- Integrating the socio-economic development plans and tasks within their respective sectors and domains with the construction and management of related national defense works and military zones; cooperating with the Ministry of Defense in managing and protecting national defense works and military zones.- Propagating and educating cadres and staff to strictly comply with regulations on the protection of national defense works and military zones;- Handling violations regarding the protection of national defense works and military zones within their jurisdiction.

4. People's Committees at all levels have the following duties and powers:

- Managing and protecting national defense works and military zones within their localities in accordance with the regulations of the Government of Vietnam; integrating socio-economic development plans with the construction and protection of national defense works and military zones within their localities; together with units of the People's Armed Forces stationed in the area, unifying the protection plans and coordinating the implementation;- Coordinating with units of the People's Armed Forces to map the boundaries of national defense works and military zones and issue land use right certificates within their jurisdiction;- Coordinating with the Vietnam Fatherland Front and its member organizations, other social organizations to propagate and educate people to strictly comply with regulations on the protection of national defense works and military zones;- Handling violations regarding the protection of national defense works and military zones within their jurisdiction.
