Specific requirements for preservation, embellishment and restoration of relics of Vietnam

The Amending Law on Cultural Heritages 2009 of Vietnam was promulgated on June 18, 2009, of which one of the notable contents is the supplements and amendments to requirements for preservation, embellishment and restoration of relics specified in the Law on Cultural Heritages 2001 of Vietnam.

Specifically, according to Clause 15 Article 1 of the Amending Law on Cultural Heritages 2009 amending and supplementing Article 34 of the Law on Cultural Heritages 2001 of Vietnam, the preservation, embellishment and restoration of relics must meet the following requirements:

- To preserve to the utmost original constituents of relics;

- To work out plans and projects and submit them to competent state agencies for approval, except minor repairs not affecting relics' original constituents. The preservation, embellishment and restoration of relics must be approved in writing by provincial-level competent agencies in charge of culture, sports and tourism, for provincial-level relics; or by the Minister of Culture, Sports and Tourism, for national relics and special national relics;

- To publicize approved plans and projects in localities where relics exist.

Those in charge of working out plans or projects or constructing or supervising construc­tion of projects on the preservation, embellish­ment and restoration of relics must possess practice eligibility certificates, for organizations, or practice certificates, for individuals.

Vietnam’s Government shall specify the competence, order and procedures for working out and approving plans and projects on the preservation, embellishment and restoration of relics.

The Minister of Culture, Sports and Tourism shall promulgate a regulation on preservation, embellishment and restoration of relics and a regulation on issuance of practice eligibility certificates or practice certificates to entities in charge of working out plans or projects or constructing or supervising construc­tion of projects on the preservation, embellish­ment and restoration of relics.
