Clause 11 of Circular 49/2014/TT-BNNPTNT stipulates the selection of individuals and organizations to perform judicial expertise as follows:

The empowerment authority selects individuals and organizations for judicial expertise in the field of agriculture and rural development from the list published in accordance with the provisions of this Circular to conduct an expertise in accordance with the nature and requirements of the case in need of expertise.
In the case where no individual or organization from the published list specified in this Circular is selected, the empowerment authority will request the Ministry of Agriculture and Rural Development or the state management agency in agriculture and rural development at the local level to recommend an individual who meets the conditions stipulated in Clause 5 of this Circular, Article 18 of the Law on Judicial Expertise, or an organization that meets the conditions stipulated in paragraph 1 of Article 19 of the Law on Judicial Expertise to perform the expertise outside the published list.
