Scope of Receiving and Handling Complaints and Denunciations of Citizens

Recently, the Government of Vietnam officially issued Decree 64/2014/ND-CP detailing the implementation of certain articles of the Law on Citizen Reception 2013.

Decree 64/2014/ND-CP stipulates the scope of receipt, processing of complaints, denunciations, petitions, and reflections by agencies and organizations regularly receiving citizens at citizen reception offices at the central, provincial, and district levels, in accordance with the provisions of Clause 4 Article 11, Clause 4 Article 12, Clause 4 Article 13 of the Law on Citizen Reception.

Part-time civil servants responsible for citizen reception at the commune level shall assist the Chairman of the Commune People's Committee in receiving citizens, processing complaints, denunciations, petitions, and reflections within the responsibilities of the People's Committee, Chairman of the People's Committee, People's Council, and Chairman of the People's Council.

Scope of Citizen Reception, Decree 64/2014/ND-CP

Moreover, representatives of agencies and organizations participating in regular citizen reception at the Citizen Reception Office shall have the following responsibilities:

- Conduct citizen reception, receive, and process complaints, denunciations, petitions, and reflections within the responsibilities of their respective agencies or organizations.- In cases where the matter falls under the responsibilities of other agencies or organizations participating in regular citizen reception at the Citizen Reception Office, guide citizens to complain, denounce, petition, or reflect to the representative of the responsible agency or organization;- In cases of complex matters involving multiple agencies and organizations, the person receiving citizens shall report to the Head of the Citizen Reception Committee for measures to cooperate with the authorities of the relevant agencies and organizations for review and handling;- In cases where there have been written guidelines or responses but citizens continue to complain, denounce, petition, or reflect, the person receiving citizens shall cooperate with the representative of the competent agency or organization to guide citizens to complain, denounce, petition, or reflect in accordance with the law;- Refuse to receive citizens in cases specified in Article 9 of the Law on Citizen Reception.
