Social housing policies are stipulated in the a href="https://lawnet.vn/vb/Luat-Nha-o-27-2023-QH15-8111D.html" class="green-text" target="_blank" >Law on Housing 2023. When implementing social housing policies, the following rules must be met:
Rules in implementing social housing support policies in Vietnam (Internet image)
Social housing is housing that receives state support for individuals eligible for housing support policies according to the stipulations of the Law on Housing 2023. According to Article 79 of the Law on Housing 2023, the implementation of social housing support policies must ensure the following principles:
The state has policies for housing development, creating conditions for everyone to have a place to live;
There is a combination of the state, businesses, community residents, family lines, and the supported subjects in the implementation of the policy;
Ensure transparency, openness, with close inspection and supervision by the competent state authorities, community residents, and the Vietnam Fatherland Front;
Ensure the correct subjects and conditions as stipulated by the Law on Housing 2023;
If one individual is eligible for multiple support policies, they will receive the highest level of support policy; if multiple individuals have the same standards and conditions, support will be prioritized in the following order: people who contributed to the revolution, relatives of martyrs, people with disabilities, those arranged for resettlement through purchase or lease-purchase of social housing, and women;
If a household has multiple individuals eligible for various support policies, only one support policy will be applied to the entire household.
Below are 12 entities eligible for assistance policies regarding social policies in Vietnam as stipulated in Article 76 of the Law on Housing 2023:
(1) Individuals who contributed to the revolution and relatives of martyrs who are eligible for housing improvement support as stipulated by the Ordinance on Preferential Treatment for Individuals who Contributed to the Revolution.
(2) Poor and near-poor households in rural areas.
(3) Poor and near-poor households in rural areas frequently affected by natural disasters and climate change.
(4) Poor and near-poor households in urban areas.
(5) Low-income individuals in urban areas.
(6) Workers and laborers working at enterprises, cooperatives, and union cooperatives inside and outside industrial zones.
(7) Officers, professional servicemen, non-commissioned officers of the People's Armed Forces, public security workers, civil servants, and defense workers serving on duty; individuals working in cryptography organizations earning salaries from the state budget.
(8) Public officials and employees as stipulated by laws on public officials and employees.
(9) Individuals who have returned official accommodation as stipulated in clause 4 of Article 125 of the Law on Housing 2023, except those who had their official accommodation recovered due to violations of the Law on Housing 2023.
(10) Households and individuals whose land has been acquired and who must relocate and demolish their houses according to the law and who have not been compensated with housing or residential land by the state.
(11) Students of universities, academies, colleges, vocational schools, and specialized schools as stipulated by law; students of public boarding ethnic minority schools.
(12) Enterprises, cooperatives, and union cooperatives located in industrial zones.
