Recently, the Ministry of Justice issued Circular 14/2014/TT-BTP guiding Decree 59/2012/ND-CP on monitoring the implementation of laws.

Circular 14/2014/TT-BTP specifically regulates the review and evaluation of the consistency and synchrony of detailed regulatory documents implementing legal normative documents.

  1. The consistency and synchrony of detailed regulatory documents are considered and evaluated based on the provisions of review according to the legal basis document and the content of the review according to the legal basis document as stipulated in Articles 11 and 12 of Decree 16/2013/ND-CP.

  2. The basic sources of information for evaluating the consistency and synchrony of detailed regulatory documents include:

- Information from agencies and units specified in Clause 3 of this Article;- Results of inspection, investigation, and survey activities regarding the implementation of laws;- Results of activities unifying legal normative documents, legislative codification, review, and inspection of legal documents, and administrative procedure control;- Reflections from agencies, organizations, individuals, mass media, and public opinion.

  1. Based on the provisions of Clause 1 of this Article, units under Ministries, agencies equivalent to Ministries, agencies under the Government of Vietnam, specialized agencies under the Provincial and District People's Committees, and specialists under the People's Committees at the communal level (hereinafter referred to as specialized agencies) that detect detailed regulatory documents with content not ensuring consistency and synchrony; propose forms of handling and send to the legal department of the Ministries, agencies equivalent to Ministries, agencies under the Government of Vietnam, Department of Justice, District Justice Office, and communal Justice - Civil status specialists (hereinafter referred to as legal agencies) for consolidation.

  2. Based on the analysis, review, and consolidation of the sources of information specified in Clause 2 of this Article, legal agencies will compile a list of detailed regulatory documents with content not ensuring consistency and synchrony, and report to the Ministers, Heads of agencies equivalent to Ministries, agencies under the Government of Vietnam, and People's Committees at the same level to consider amendments and supplements under their jurisdiction or propose competent agencies to consider and handle.
