Responsibilities of the People's Court in Mediation and Dialogue Activities at the Court

On June 16, 2020, the National Assembly officially passed the Law on Mediation and Dialogue at the Court 2020, which took effect from January 1, 2021. This law specifically stipulates the responsibilities of the People's Court in mediation and dialogue activities at the Court.

To be specific, in Article 7 of the Law on Mediation and Dialogue at Court 2020, the Chief Justice of the Supreme People's Court stipulates the detailed responsibilities of the Supreme People's Court, the Provincial People's Court, and the District People's Court as follows:

1. Responsibilities of the Supreme People's Court

- Organize and manage mediation and dialogue activities as stipulated.- Conduct training and professional development in mediation and dialogue skills.- Regulate the issuance, revocation, and use of the Mediator's card.- Coordinate with the Government of Vietnam in proposing to the National Assembly the budget for mediation and dialogue activities at court.- Guide, inspect the management, use, and settlement of the budget for mediation and dialogue activities at court as per legal provisions.- Inspect the implementation and handle violations in mediation and dialogue activities.- Resolve complaints regarding decisions on complaint resolutions of the Provincial People's Court.- Report to the National Assembly on mediation and dialogue activities at court in annual work reports.- Perform other tasks as prescribed by this Law.

2. Responsibilities of the Provincial People's Court

- Organize mediation and dialogue activities as stipulated.- Appoint, reappoint, revoke, and remove Mediators.- Issue and revoke Mediator’s cards.- Provide professional training; reward and handle violations related to Mediators.- Assign, support, and guide Mediators in conducting mediation and dialogue; evaluate and comment on the performance of the Mediators of the Provincial People's Court.- Allocate venues, equipment, and other necessary conditions for mediation and dialogue activities at court.- Resolve complaints regarding decisions of the Chief Justice of the Provincial People's Court on the termination of a Mediator’s duties.- Report on mediation and dialogue activities at court as stipulated by the Chief Justice of the Supreme People's Court.- Perform other tasks as prescribed by this Law.

3. Responsibilities of the District People's Court

- Organize mediation and dialogue activities as stipulated.- Propose the Provincial People's Court appoint, reappoint, and remove Mediators.- Assign, support, and guide Mediators in conducting mediation and dialogue; evaluate and comment on the performance of the Mediators.- Support professional development, propose rewards, and suggest handling violations related to the Mediators of the District People's Court.- Allocate venues, equipment, and other necessary conditions for mediation and dialogue activities at court.- Report on mediation and dialogue activities at court as stipulated by the Chief Justice of the Supreme People's Court.- Perform other tasks as prescribed by this Law.
