On November 26, 2024, the National Assembly of Vietnam passed the Law on Urban and Rural Planning 2024 during the 8th Session, which takes effect from July 1, 2025.

Responsibilities for organizing the preparation of planning tasks, urban and rural planning in Vietnam from July 1, 2025​

(1) The Ministry of Construction of Vietnam shall organize the planning tasks, urban and rural planning for the following:

- Comprehensive planning for new urban areas whose planning scope involves the administrative boundaries of two or more provinces;

- Urban planning and planning of functional areas as assigned by the Prime Minister of the Government of Vietnam.

(2) Agencies or organizations established by the Prime Minister of Vietnam are assigned to manage functional areas to organize the planning tasks for those functional areas.

(3) Agencies or organizations under the Provincial People's Committee, assigned to manage functional areas, shall organize the planning tasks for those functional areas.

(4) Except as provided in (1), (2), and (3), the Provincial People's Committee shall organize the planning tasks, urban, and rural planning within its administrative boundary management in the following cases:

- Comprehensive planning for centrally-governed cities, economic zones, and national tourist areas;

- Comprehensive planning for new urban areas with a projected population equivalent to a Grade-I city; comprehensive planning for new urban areas whose planning scope involves two or more district-level administrative boundaries;

- Underground space planning, specialized technical infrastructure planning for centrally-governed cities;

- Zonal, detailed planning for areas with planning scopes involving two or more district-level administrative boundaries;

- Comprehensive, zonal, and detailed planning for areas of national importance in politics, culture, history, security, and defense as determined in national, regional, and centrally-governed city planning by the Prime Minister of the Government of Vietnam.

(5) Except as provided in (2), (3), (4), (7) and (8), the District People's Committee shall organize planning tasks, urban and rural planning within its administrative boundary management in the following cases:

- Comprehensive planning for provincial cities, district-level towns, commune-level towns; comprehensive planning for new urban areas within district administrative boundaries; district comprehensive planning;

- Zonal, detailed planning within its administrative boundary management or with scopes involving two or more commune-level administrative boundaries.

(6) Except as provided in (5), (7) and (8), the Commune People's Committee shall organize planning tasks, comprehensive planning for communes, detailed planning for rural residential areas and construction zones within its administrative boundary management.

(7) Agencies or organizations with functions in construction investment management and land resources shall organize zoning or detailed planning tasks to auction land-use rights or select investors for projects using land when authorized by the Provincial or District People's Committees.

(8) Investors, as per the laws on investment and related laws, selected to implement investment projects, shall organize the planning tasks, zoning planning for functional areas, and detailed planning in areas designated for project implementation.

(9) The agencies organizing urban and rural planning as stipulated in this Article may assign subordinate agencies or units to organize or select qualified consulting organizations, suitable to the work content requirements as prescribed in Clause 1, Article 18 of the Law on Urban and Rural Planning 2024 to carry out planning tasks or adjustments to planning documents.

(10) The organizing agencies, i.e., the Ministry of Construction, the Provincial People's Committee, and the District People's Committee, are tasked with planning tasks, urban and rural planning for their subordinate agencies or units, ensuring the independence between the development and appraisal of planning tasks, urban and rural planning.
