Repeal of Certain Circulars on Recruitment of Officials and Public Employees

On August 8, 2023, the Minister of Home Affairs issued Circular 12/2023/TT-BNV to repeal the Circulars regulating the recruitment of officials and public employees, promotion of officials, upgrading public employees, and implementing contract policies for certain types of work in state administrative agencies and public service providers.

The Circular repeals all 10 Circulars regulating the recruitment of officials and public employees, promotion of officials, upgrading public employees, and implementing contract policies for certain types of work in state administrative agencies and public service providers.

To be specific, the 11 Circulars that are completely repealed include:

1. Circular 13/2010/TT-BNV of the Minister of Home Affairs detailing some provisions on the recruitment and promotion of officials according to Decree 24/2010/ND-CP of the Government of Vietnam on the recruitment, utilization, and management of officials.

2. Circular 05/2012/TT-BNV of the Minister of Home Affairs amending and supplementing certain provisions of Circular 13/2010/TT-BNV of the Minister of Home Affairs detailing some provisions on the recruitment and promotion of officials according to Decree 24/2010/ND-CP of the Government of Vietnam on the recruitment, utilization, and management of officials.

3. Circular 06/2013/TT-BNV of the Minister of Home Affairs repealing Article 19 of Circular 13/2010/TT-BNV of the Minister of Home Affairs detailing some provisions on the recruitment and promotion of officials according to Decree 24/2010/ND-CP of the Government of Vietnam on the recruitment, utilization, and management of officials.

4. Circular 03/2015/TT-BNV of the Minister of Home Affairs amending and supplementing Article 9 of Circular 13/2010/TT-BNV of the Minister of Home Affairs detailing some provisions on the recruitment and promotion of officials according to Decree 24/2010/ND-CP of the Government of Vietnam on the recruitment, utilization, and management of officials.

5. Circular 05/2017/TT-BNV of the Minister of Home Affairs amending and supplementing certain provisions of Circular 11/2014/TT-BNV and Circular 13/2010/TT-BNV of the Minister of Home Affairs on professional standards, appointment of ranks, and salary arrangement for administrative officials and the organization of promotion exams for officials.

6. Circular 12/2012/TT-BNV of the Minister of Home Affairs regulating professional titles and changing professional titles for public employees.

7. Circular 15/2012/TT-BNV of the Minister of Home Affairs guiding the recruitment, signing of work contracts, and compensation for training and retraining costs for public employees.

8. Circular 04/2015/TT-BNV of the Minister of Home Affairs amending and supplementing Article 6 of Circular 15/2012/TT-BNV of the Minister of Home Affairs guiding the recruitment, signing of work contracts, and compensation for training and retraining costs for public employees.

9. Circular 15/2001/TT-BTCCBCP of the Minister, Head of the Government Personnel Committee (now is the Minister of Home Affairs) guiding the implementation of Decree 68/2000/ND-CP of the Government of Vietnam on implementing contract policies for certain types of work in state administrative agencies and public service providers.

10. Circular 03/2019/TT-BNV of the Minister of Home Affairs amending and supplementing certain regulations on recruitment of officials and public employees, promotion of officials, upgrading professional titles of public employees, and implementing contract policies for certain types of work in state administrative agencies and public service providers.

Circular 12/2023/TT-BNV comes into effect from October 01, 2023.
