Forms of film production funding from the state budget in Vietnam

Films produced using the state budget are a unique cultural product, associated with copyright from the creation phase to completion. Film production using state budget for serving political tasks stipulated in point a clause 2 Article 5 of the Law on Cinematography 2022 is carried out by way of task assignment, ordering, or bidding.

- For documentary films, scientific films, animated films according to the plan serving political tasks on the topics of history, revolution, leaders, great men, national heroes, children, highlands, mountainous areas, borders, islands, ethnic minority areas, preserving and promoting Vietnamese cultural values, the method of task assignment or ordering is implemented.

- For feature films, films combining various types:

+ The method of task assignment, ordering is implemented for film production projects according to the plan serving political tasks on the topics of history, revolution, leaders, great men, national heroes, children, highlands, mountainous areas, borders, islands, ethnic minority areas;

+ The method of bidding is implemented for film production projects according to the plan serving political tasks on the topics of preserving and promoting Vietnamese cultural values.

Procedures for selecting film production projects with funding from the state budget in Vietnam

According to Article 8 of the Decree 131/2022/ND-CP on the procedures for selecting film production projects with funding from the state budget, according to the approved film production plan and the script assessment result of the Council assessing film production scripts with funding from the state budget, the investor and project management agency shall select film production projects as follows:

(1) For the method of task assignment, ordering:

The film production facility with the selected script prepares the Film Production Project Dossier to submit to the project management agency for the consideration of the State Budget Film Production Project Selection Council, including:

- Dossiers as prescribed by law on task assignment, ordering products, public services using the state budget.

- Dossier proving financial capacity, production plan, progress.

- Estimated production costs (for task assignment method) or pricing scheme for film production ordering (for ordering method), including:

+ Total estimated production costs;

+ List of technical equipment (clearly stating model number, features, technical specifications) serving the film production project (including available equipment and leased, rented equipment);

+ Labor and wage costs.

- Distribution, dissemination plan for the film.

- Written assurance of copyright for the film script.

- Dossier for feature films and films combining various types include:

+ Script, scene breakdown script, and production plan;

+ List of some key creators for the film project including director, screenwriter, cinematographer, film production manager.

- Dossier for documentary films, scientific films, and animated films include:

+ Script, scene breakdown script groups;

+ List of some key creators for the film project including director, screenwriter, artist (for animated films), cinematographer, film production manager.

The State Budget Film Production Project Selection Council, established by the investor, receives the dossier and evaluates it according to the regulations of the Minister of Culture, Sports and Tourism. The evaluation results of the Council are to advise the investor in considering, deciding on the selection of film production projects using state budget, deciding on the method of task assignment, ordering; in case of selecting the ordering method, deciding the maximum price and specific price according to the legal regulations on pricing;

The project management agency signs the film production ordering contract with the film production facility or submits to the investor for the decision on assigning tasks to the film production facility with the selected project.

(2) For the bidding method implemented according to the law on bidding and the dossier includes:

- Dossiers as prescribed by law on bidding.

- Dossier proving financial capacity, production plan, progress.

- Estimated production costs including:

+ Total estimated production costs;

+ List of technical equipment (clearly stating model number, features, technical specifications) serving the film production project (including available equipment and leased, rented equipment);

+ Labor and wage costs.

- Distribution, dissemination plan for the film and profit-sharing scheme.

+ Estimated distribution costs;

+ Estimated distribution revenue.

- Written assurance of copyright for the film script.

- Dossier for feature films and films combining various types include:

+ Script, scene breakdown script, and production plan;

+ List of some key creators for the film project including director, screenwriter, cinematographer, film production manager.

- Dossier for documentary films, scientific films, and animated films include:

+ Script, scene breakdown script groups;

+ List of some key creators for the film project including director, screenwriter, artist (for animated films), cinematographer, film production manager.
