Regulations on the Management of Fees and Charges in the Field of Immigration in Vietnam

Recently, the Minister of Finance issued Circular 41/2020/TT-BTC amending and supplementing several articles of Circular 219/2016/TT-BTC dated November 10, 2016, stipulating the collection rates, collection policies, payment, management, and use of fees and charges in the fields of exit, entry, transit, and residence in Vietnam.

Translation

According to Clause 1, Article 1 of Circular 41/2020/TT-BTC amending Article 7 of Circular 219/2016/TT-BTC on the management of fees and charges in the field of exit, entry, transit, and residence in Vietnam as follows:

First, for fee-collecting organizations such as the Immigration Department (Ministry of Public Security); Police, and Provincial Border Guard Command of centrally governed cities and provinces:

- Fee-collecting organizations are permitted to retain 20% of the collected fees to cover expenses according to the provisions of Article 5 of Decree 120/2016/ND-CP dated August 23, 2016 of the Government of Vietnam. Other expenses related to tasks, services, and fee collection include:

+ Expenses for purchasing flight tickets, accommodation, hiring interpreters, guarding detained foreigners; medical treatment for sick foreigners; escorting foreigners who illegally reside or violate the law back to their countries. The retained fees are only used to fund these expenses when the representative office of the violator's country does not cover the costs;

+ Expenses for training and enhancing the capacity and knowledge of officers and soldiers involved in immigration management;

+ Expenses for applying advanced and modern technological science serving immigration management;

+ Expenses for negotiations and cooperation with foreign partners in issuing visas and related immigration documents for foreigners to enter Vietnam;

+ Supplements to income and improving the living standards of officers and soldiers involved in immigration management as per legal regulations (if any).

- Submit 80% of the collected fees to the state budget according to the current state budget item, sub-item list.

Second, for fee-collecting organizations such as the Consular Department, Ho Chi Minh City Department of Foreign Affairs:

- Fee-collecting organizations shall submit all collected fees to the state budget, except as specified in point b of this clause. The cost of implementing tasks, services, and collecting fees is funded by the state budget and included in the organization’s budget estimates according to policies and state budget spending norms.

- If the fee-collecting organization is a state agency and is given a budget from the collected fees following Clause 1, Article 4 of Decree 120/2016/ND-CP dated August 23, 2016 of the Government of Vietnam, they may retain 20% of the collected fees to cover expenses according to the provisions of Article 5 of Decree 120/2016/ND-CP dated August 23, 2016 of the Government of Vietnam and Article 4 of Circular 07/2020/TT-BTC dated February 03, 2020 of the Minister of Finance on financial management policies and assets for Vietnamese agencies overseas. Submit 80% of the collected fees to the state budget according to the current state budget item, sub-item list.

Fee-collecting organizations must submit 100% of the collected charges to the state budget according to the current state budget item, sub-item list. The cost of implementing tasks and collecting charges is funded by the state budget and included in the organization’s budget estimates according to policies and state budget spending norms.
